The Civil Service Director of the Office of Management and\n\nEnterprise Services may delegate the authority to issue a final\n\nagency order adverse to a party to an agency administrative law\n\njudge if:\n\n1. The administrative law judge has a general knowledge of the\n\nCivil Service and Human Capital Modernization Act and rules\n\npromulgated thereto;\n\n2. The administrative law judge:\n\na. is currently licensed to practice law by the Supreme\n\nCourt of this state,\n\nb. has a working knowledge of the Administrative\n\nProcedures Act and administrative rules of the Office\n\nof Management and Enterprise Services,\n\nc. is not an owner, stockholder, employee, or officer of,\n\nnor has any other business relationship with, any\n\ncorporation, partnership, or other business or entity\n\nthat is subject to regulation by the Office of\n\nManagement and Enterprise Services,\n\nd. is separate and apart from the legal division or\n\noffice of general counsel of the Office of Management\n\nand Enterprise Services,\n\ne. is not responsible to or subject to the supervision or\n\ndirection of an employee or agent engaged in the\n\nperformance of investigative or prosecuting functions\n\nfor the Office of Management and Enterprise Services,\n\nand\n\nf. has not been engaged in the performance of\n\ninvestigative or prosecuting functions for the Office\n\nof Management and Enterprise Services regarding the\n\nparty receiving the final agency order; and\n\n3. The Civil Service Director in delegating the authority to\n\nissue final agency orders adverse to a party pursuant to this\n\nsection specifically designates by written agency policy and\n\nprocedure the type or category of final agency order which may be\n\nissued by the administrative law judge.\n\nB. The provisions of this section shall not be construed to\n\nauthorize or allow restraints on the authority of the Civil Service\n\nDirector to adopt, reject, review, modify, or correct the findings\n\nof fact and conclusions of law or any proposed order issued by the\n\nadministrative law judge.\n\nC. When the administrative law judge issues a final agency\n\norder, that order becomes the final order of the Office of\n\nManagement and Enterprise Services, Civil Service Division without\n\nfurther proceeding unless there is a request for rehearing,\n\nreopening, or reconsideration pursuant to Section 317 of Title 75 of\n\nthe Oklahoma Statutes or a filing for judicial review pursuant to\n\nSection 318 of Title 75 of the Oklahoma Statutes.","path":["OK Code","Title 75"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os75.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f39fa1c0867b6f0d479502a756a3d8cbe66ed7988c0a67829ac7ee57590059f7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-75-75-311.1","next":"us-ok/okla.-stat.-tit.-75-75-312"},"notice":"GroundRules: Original legal text.
