Stat. tit. 75, § 75-316","heading":"Disqualification of hearing examiner or agency member","body":"A hearing examiner or agency member shall withdraw from any\n\nindividual proceeding in which he cannot accord a fair and impartial\n\nhearing or consideration. Any party may request the\n\ndisqualification of a hearing examiner or agency member, on the\n\nground of his inability to give a fair and impartial hearing, by\n\nfiling an affidavit, promptly upon discovery of the alleged\n\ndisqualification, stating with particularity the grounds upon which\n\nit is claimed that a fair and impartial hearing cannot be accorded.\n\nThe issue shall be determined promptly by the administrative head of\n\nthe agency, or, if it affects a member or members of the agency, by\n\nthe remaining members thereof, if a quorum. Upon the entry of an\n\norder of disqualification affecting a hearing examiner, the agency\n\nshall assign another in his stead or shall conduct the hearing\n\nitself. Upon the disqualification of a member of an agency, the\n\nagency shall proceed with the proceeding if a quorum remains. If a\n\nquorum no longer exists, by virtue of the member's disqualification,\n\nthe Governor immediately shall appoint a member pro tempore to sit\n\nin place of the disqualified member in that proceeding.
