Stat. tit. 75, § 75-319","heading":"Staying enforcement of agency decision pending review","body":"(1) The filing of a proceeding for review shall not stay\n\nenforcement of the agency decision; but the agency may do so, or the\n\nreviewing court may order a stay upon such terms as it deems proper,\n\nand shall do so whenever required by subsection (2) of this section.\n\n(2) In every proceeding in any court for the review of an order\n\nof an agency, upon the filing of an application, supported by\n\nverified statements of material fact establishing that the\n\nenforcement of the order pending final decision would result in\n\npresent, continuous and irreparable impairment of the constitutional\n\nrights of the applicant, a stay of the enforcement of such order and\n\nof the accrual of penalties thereunder shall be entered upon the\n\ncondition that:\n\n(a) injury to adverse parties or to the public, as the case may\n\nbe, can be obviated through the furnishing of security adequate to\n\ncompensate for any loss which may be suffered as a result of the\n\nstay in the event the order is affirmed, in whole or in part;\n\n(b) a supersedeas bond, in the amount and with sureties\n\nprescribed and approved by the reviewing court, in its sound\n\njudicial discretion, as adequate to meet requirement (a), be filed\n\nwith such court. If an application for supersedeas hereunder,\n\naccompanied by a proposal for a supersedeas bond, is not acted upon\n\nby the court within forty-five (45) days from the filing thereof,\n\nthe order appealed from thereupon shall be automatically superseded\n\nand stayed, during the pendency of the appeal, upon the filing of\n\nthe bond proposed in the application, provided, however, that the\n\ncourt thereafter may reasonably modify the terms of the supersedeas\n\nas to amount and surety whereupon the appellant shall comply with\n\nsuch modification in order to maintain the supersedeas in effect.","path":["OK Code","Title 75"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os75.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"392b59e24d16f44d46705e6203ec2639faceb8c4eb42b1bb0fb7719e076e6a82","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-75-75-318","next":"us-ok/okla.-stat.-tit.-75-75-320"},"notice":"GroundRules: Original legal text.
