Stat. tit. 75, § 75-505","heading":"Promulgated rules - Petition objecting to adverse effect","body":"on small business.\n\nA. For promulgated rules, any adversely affected small business\n\nmay file a written petition with the agency that has promulgated the\n\nrules objecting to all or part of any rule adversely affecting small\n\nbusiness on any of the following grounds:\n\n1. The actual effect on small business was not reflected in, or\n\nsignificantly exceeded, the small business impact statement\n\nformulated by the agency pursuant to the provisions of paragraph 4\n\nof subsection A and paragraph 6 of subsection B of Section 303 of\n\nthis title prior to the adoption of the rules;\n\n2. These impacts were either not previously considered at the\n\npublic hearing on the rules or there was no public hearing on the\n\nrules; or\n\n3. The technology, economic conditions, or other relevant\n\nfactors justifying the purpose for the rules have changed or no\n\nlonger exist.\n\nB. The agency shall promptly consider the petition and may seek\n\nadvice and counsel regarding the petition. Within sixty (60) days\n\nafter the submission of the petition, the agency shall determine\n\nwhether the impact statement or the public hearing addressed the\n\nactual and significant impact on small business or if conditions\n\njustifying the rule have changed.
