Except as provided in subsections B, C and D of\n\nthis section, the fair market value of total gross assets at the\n\ntime of a merger or consolidation increases annually at a rate equal\n\nto the sum of:\n\n1. The prime rate as listed in the first edition of \"The Wall\n\nStreet Journal\" published for each calendar year since the merger or\n\nconsolidation, unless the prime rate is not published in that\n\nedition of \"The Wall Street Journal\", in which case any reasonable\n\ndetermination of the prime rate on the first day of the year may be\n\nused; and\n\n2. One percent (1%).\n\nB. The rate provided for in subsection A of this section shall\n\nnot be compounded.\n\nC. The adjustment of fair market value of total gross assets\n\ncontinues as provided under subsection A of this section until the\n\ndate the adjusted value is first exceeded by the cumulative amounts\n\nof successor asbestos-related liabilities paid or committed to be\n\npaid by or on behalf of the innocent successor corporation or a\n\npredecessor, or by or on behalf of a transferor, after the time of\n\nthe merger or consolidation for which the fair market value of total\n\ngross assets is determined.\n\nD.
