Stat. tit. 76, § 76-17","heading":"Medical malpractice - Reporting of the claim to licensing","body":"board.\n\nWhenever a claim of personal injury is made against any\n\npractitioner of the healing arts or a licensed hospital, a report\n\nshall be made to the appropriate licensing board or agency by the\n\nliability insurer of such practitioner or hospital within sixty (60)\n\ndays after receipt of information that a claim is being made. In\n\nthe event that such claim is made against a party not insured, the\n\nreport shall be made by the party. The report shall be in writing\n\non a form containing the following information:\n\n1. The name and address of the practitioner or hospital;\n\n2. The name, age and address of the claimant;\n\n3. A brief statement of the nature of the injury, illness or\n\ncondition complained of and the act or omission complained of; and\n\n4. Whether a suit is pending and, if so, the court, style and\n\ndocket number of the action.\n\nAnd whenever such claim or suit is concluded, the disposition\n\nshall be reported to the appropriate board or agency promptly.\n\nThis report shall be privileged except as hereinafter provided.\n\nThe licensing board or agency shall take any remedial,\n\ndisciplinary or corrective action as it may deem warranted by the\n\nfacts contained in the report.\n\nAny person or liability insurer failing to furnish a report on a\n\nclaim as required in this section shall be guilty of a misdemeanor.\n\nFurther, the board or agency shall annually furnish the\n\nPresident Pro Tempore of the Senate and the Speaker of the House of\n\nRepresentatives a full report of all such claims except that names\n\nand addresses of all parties shall be omitted.
