Stat. tit. 76, § 76-21","heading":"Presumption of negligence","body":"In any action arising from negligence in the rendering of\n\nmedical care, a presumption of negligence shall arise if the\n\nfollowing foundation facts are first established:\n\n1. The plaintiff sustained any injury;\n\n2. Said injury was proximately caused by an instrumentality\n\nsolely within the control of the defendant or defendants; and\n\n3.
