This section shall be known and may be cited as the\n\n\"Volunteer Professional Services Immunity Act\".\n\nB. As used in the Volunteer Professional Services Immunity Act,\n\n\"charitable clinic\" means a nonprofit entity organized for the\n\npurpose of providing health care services without charge or for a\n\nminimal fee.\n\nC. Any volunteer professional or volunteer health practitioner\n\nand any organization that arranges for the care given by the\n\nvolunteer professional shall be immune from liability in a civil\n\naction on the basis of any act or omission of the volunteer\n\nprofessional or volunteer health practitioner resulting in damage or\n\ninjury if:\n\n1. The volunteer professional or volunteer health practitioner\n\nservices were provided at a charitable clinic where the professional\n\nor practitioner receives no compensation for any treatment provided\n\nat the clinic;\n\n2. The volunteer professional or volunteer health practitioner\n\nwas acting in good faith and, if licensed, the services provided\n\nwere within the scope of the license of the volunteer professional\n\nor volunteer health practitioner;\n\n3. The volunteer professional or volunteer health practitioner\n\ncommits the act or omission in the course of providing services; and\n\n4. The damage or injury was not caused by gross negligence or\n\nwillful and wanton misconduct by the volunteer professional or\n\nvolunteer health practitioner.\n\nD. In the event the volunteer professional or volunteer health\n\npractitioner refers the patient covered by this section to another\n\nvolunteer professional or volunteer health practitioner for\n\nadditional treatment, the referred volunteer professional or\n\nvolunteer health practitioner shall be subject to the provisions of\n\nthis section if:\n\n1. The referred volunteer professional or volunteer health\n\npractitioner provides services without receiving any compensation\n\nfor the treatment;\n\n2. The referred volunteer professional or volunteer health\n\npractitioner was acting in good faith and, if licensed, the services\n\nprovided were within the scope of the license of the referred\n\nvolunteer professional or volunteer health practitioner;\n\n3. The referred volunteer professional or volunteer health\n\npractitioner commits the act or omission in the course of providing\n\nservices; and\n\n4. The damage or injury was not caused by gross negligence or\n\nwillful and wanton misconduct by the referred volunteer professional\n\nor volunteer health practitioner.\n\nE. The provisions of this section shall not affect the\n\nliability that any person may have which arises from the operation\n\nof a motor vehicle, watercraft, or aircraft in rendering the\n\nservice, care, assistance, advice or other benefit as a volunteer\n\nprofessional or volunteer health practitioner.\n\nF. The immunity from civil liability provided by this section\n\nshall extend only to the actions taken by a person rendering the\n\nservice, care, assistance, advice or other benefit as a volunteer\n\nprofessional or volunteer health practitioner, and does not confer\n\nany immunity to any person for actions taken by the volunteer\n\nprofessional or volunteer health practitioner prior to or after the\n\nrendering of the service, care, assistance, advice or other benefit\n\nas a volunteer professional or volunteer health practitioner.\n\nG. For the purpose of this section, the term \"volunteer\n\nprofessional\" and \"referred volunteer professional\" means a person\n\nwho voluntarily provides professional medically related services\n\nwithout compensation or expectation of compensation of any kind. A\n\nvolunteer professional or a referred volunteer professional shall\n\ninclude the following licensed professionals, including those\n\npersons licensed in accordance with Section 493.5 of Title 59 of the\n\nOklahoma Statutes:\n\n1. Physician;\n\n2. Physician assistant;\n\n3. Registered nurse;\n\n4. Advanced practice nurse or vocational nurse;\n\n5. Pharmacist;\n\n6. Podiatrist;\ntation of compensation of any kind. A\n\nvolunteer professional or a referred volunteer professional shall\n\ninclude the following licensed professionals, including those\n\npersons licensed in accordance with Section 493.5 of Title 59 of the\n\nOklahoma Statutes:\n\n1. Physician;\n\n2. Physician assistant;\n\n3. Registered nurse;\n\n4. Advanced practice nurse or vocational nurse;\n\n5. Pharmacist;\n\n6. Podiatrist;\n\n7. Dentist or dental hygienist; or\n\n8. Optometrist.\n\nA volunteer professional shall be engaged in the active practice of\n\na medical professional or retired from a medically related\n\nprofession, if still eligible to provide medically related\n\nprofessional services within this state.\n\nH. For the purposes of this section, the term \"volunteer health\n\npractitioner\" and \"referred volunteer health practitioner\" means a\n\nperson who voluntarily provides health-related services without\n\ncompensation or expectation of compensation of any kind. A\n\nvolunteer health practitioner or referred volunteer health\n\npractitioner shall include the following:\n\n1. Certified nurse aide;\n\n2. Chiropractor;\n\n3. Dental assistant;\n\n4. Dental technician;\n\n5. Dietitian/nutritionist;\n\n6. Emergency medical technician;\n\n7. Licensed alcohol and drug counselor;\n\n8. Licensed behavioral practitioner;\n\n9. Licensed clinical social worker;\n\n10. Licensed practical nurse;\n\n11. Licensed professional counselor;\n\n12. Marital/family therapist;\n\n13. Medical assistant;\n\n14. Medical laboratory technologist;\n\n15. Medical technician;\n\n16. Nuclear medicine technologist;\n\n17. Occupational therapist;\n\n18. Orthopedic technologist;\n\n19. Paramedic;\n\n20. Pharmacy technician;\n\n21. Physical therapist;\n\n22. Psychologist;\n\n23. Radiology technician/technologist;\n\n24. Respiratory therapist;\n\n25. Sonographer;\n\n26. Speech/language pathologist;\n\n27. Veterinarian; and\n\n28. Veterinary technician.\n\nA volunteer health practitioner shall be engaged as an active\n\nhealth practitioner or retired from a health-related practice if\n\nstill eligible to provide health-related services within this state.\n\nI. Any person or entity participating in the Oklahoma Medical\n\nReserve Corps and assisting with emergency management, emergency\n\noperations, or hazard mitigation in response to any emergency, man-\n\nmade disaster, or natural disaster, or participating as authorized\n\nin public health initiatives, disaster drills, or other activities\n\ndesigned to strengthen emergency response that are endorsed by a\n\ncity-county health department, county health department or the state\n\nhealth department in the State of Oklahoma, shall not be liable for\n\ncivil damages on the basis of any act or omission, if:\n\n1. The person was acting in good faith and within the scope of\n\nthe official duties and functions of the Oklahoma Medical Reserve\n\nCorps; and\n\n2. The acts or omissions were not caused from gross, willful,\n\nor wanton acts of negligence.\n\nJ. This section shall apply to all civil actions filed on or\n\nafter:\n\n1. November 1, 2004, for those persons listed in subsection G\n\nof this section; and\n\n2.
