As used in this section:\n\n1. \"Food\" means unserved perishable, salvageable food that has\n\nbeen properly preserved for human consumption; and\n\n2. \"Restaurant\" means any eating establishment regardless of\n\nseating capacity including public school district cafeterias.\n\nB. Any restaurant that, in good faith and without compensation,\n\ndonates food which is prepared and subsequently donated by the\n\nrestaurant shall not be liable for damages caused by the condition\n\nof the food, unless the damages by the restaurant result from an\n\nintentional act, omission, gross negligence or the restaurant knew\n\nor should have known of the condition of the food that resulted in\n\nthe damages.\n\nC.
