Stat. tit. 76, § 76-5","heading":"Short title — Good Samaritan Act — Responsibility for","body":"negligence.\n\nA. Everyone is responsible, not only for the result of his or\n\nher willful acts, but also for an injury occasioned to another by\n\nhis or her want of ordinary care or skill in the management of his\n\nor her property or person, except so far as the latter has,\n\nwillfully or by want of ordinary care, brought the injury upon\n\nhimself or herself, and except as hereinafter provided.\n\n1. Where no prior contractual relationship exists, any person\n\nlicensed to practice any method of treatment of human ailments,\n\ndisease, pain, injury, deformity, mental or physical condition, or\n\nlicensed to render services ancillary thereto, including licensed\n\nregistered and practical nurses, who, under emergency circumstances\n\nthat suggest the giving of aid is the only alternative to probable\n\ndeath or serious bodily injury, in good faith, voluntarily and\n\nwithout compensation, renders or attempts to render emergency care\n\nto an injured person or any person who is in need of immediate\n\nmedical aid, wherever required, shall not be liable for damages as a\n\nresult of any acts or omissions except for committing gross\n\nnegligence or willful or wanton wrongs in rendering the emergency\n\ncare.\n\n2. Where no prior contractual relationship exists, any person\n\nwho in good faith renders or attempts to render emergency care\n\nconsisting of artificial respiration, restoration of breathing, use\n\nof an emergency opioid antagonist to prevent opioid overdose, or\n\npreventing or retarding the loss of blood, or aiding or restoring\n\nheart action or circulation of blood to the victim or victims of an\n\naccident or emergency, wherever required, shall not be liable for\n\nany civil damages as a result of any acts or omissions by such\n\nperson in rendering the emergency care. As used in this paragraph,\n\n“emergency opioid antagonist” means a drug including, but not\n\nlimited to, naloxone that blocks the effects of opioids and that is\n\napproved by the United States Food and Drug Administration for the\n\ntreatment of an opioid overdose.\n\n3. Where no prior contractual relationship exists, any person\n\nlicensed to perform surgery or dentistry in this state who in good\n\nfaith renders emergency care requiring the performance of an\n\noperation or other form of surgery upon any individual who was the\n\nvictim of an accidental act shall not be liable for any civil\n\ndamages or subject to criminal prosecution as the result of\n\nnonconsent whereby such person renders or attempts to render the\n\nemergency surgery or operation voluntarily and without compensation,\n\nwherever required, except for gross negligence or willful or wanton\n\nwrongs committed in rendering the care; provided, however, that the\n\nexemption granted by this subsection shall not attach if the victim\n\nis an adult who is conscious and capable of giving or refusing his\n\nor her consent; or if the victim’s spouse, or parent, or guardian in\n\nthe case of a minor or incompetent person, can be reached in a\n\nreasonable time considering the condition of the victim and\n\nconsistent with good medical practice, and unless concurrence is\n\nobtained for such emergency surgery or operation from one other\n\nperson licensed to perform surgery in this state.\n\n4. Where no contractual relationship exists, any person, or any\n\nmember of his or her immediate family or household, who has been\n\napproved by the local P.T.A. or other local sponsoring agency or\n\norganization, who has registered with the local municipal police\n\nchief or the county sheriff, and who has been granted appropriate\n\nauthorization by either the police chief or the county sheriff to\n\nindicate by sign in the window of his or her home or in any other\n\ntangible or identifiable manner that he or she will extend aid and\n\nrefuge to persons on the streets in apparent danger, or in need of\n\naid, by inviting those persons into the person’s home, or onto\n\nen granted appropriate\n\nauthorization by either the police chief or the county sheriff to\n\nindicate by sign in the window of his or her home or in any other\n\ntangible or identifiable manner that he or she will extend aid and\n\nrefuge to persons on the streets in apparent danger, or in need of\n\naid, by inviting those persons into the person’s home, or onto\n\npremises thereof, and in good faith provides such refuge or aid\n\nwithout objection of the endangered or needy person, whether child\n\nor adult, neither the person extending the aid and refuge nor the\n\nhomeowner or head of household shall be liable for civil damages as\n\na result of actions or omissions in rendering emergency physical\n\ncare to the body of the aided person; nor shall they be liable for\n\ncivil damages for any other injury in the home, or on premises\n\nthereof, to the person aided, nor for any failure to provide or\n\narrange for his or her police protection or other protection or\n\nmedical treatment, when the actions or omissions were those of an\n\nordinarily reasonably prudent person under the circumstances without\n\nwant of ordinary care or skill.\n\nB.
