Stat. tit. 76, § 76-5.3","heading":"Hearing - Board and composition - Application of","body":"Administrative Procedures Act - Approval of claim.\n\nA. Upon presentation of any claim, a hearing shall be had\n\nbefore a board composed of two (2) members of the Governor's staff,\n\nas the Governor shall designate, one (1) member of the Attorney\n\nGeneral's staff, as the Attorney General shall designate, and two\n\n(2) members of the Legislature, one of whom shall be appointed by\n\nthe Speaker of the House of Representatives and one of whom shall be\n\nappointed by the President Pro Tempore of the Senate.\n\nB. The terms and provisions of the Administrative Procedures\n\nAct shall apply to all proceedings before the board. If the board\n\ndetermines, on the basis of a preponderance of such evidence, that\n\nthe state should indemnify the claimant for the injury, death or\n\ndamage sustained, it shall approve the claim for payment. In no\n\nevent shall a claim be approved by the board in excess of Five\n\nThousand Dollars ($5,000.00).\n\nC.
