Any donor who makes a good-faith donation of food which is\n\nat the time of donation fit for human consumption to a charitable\n\norganization or nonprofit corporation shall not be liable for\n\ndamages in any civil suit or subject to criminal prosecution for any\n\ninjury resulting from the nature, age, condition or packaging of the\n\ndonated food, unless the injury or death is a direct result of the\n\ngross negligence, recklessness, or intentional misconduct of the\n\ndonor.\n\nB. Information shall be posted with the State Department of\n\nHealth on its website under the existing heading \"Protective Health\"\n\nwithin a new section labeled \"Options for Safe Food Donation\" with\n\nhyperlinks to Section 5.6 of Title 76 of the Oklahoma Statutes,\n\nSection 5-601 et seq. of Title 2 of the Oklahoma Statutes, Oklahoma\n\nAdministration Code Title 310: Chapter 257, 42 U.S.C., Section 1791,\n\nand to the website of Oklahoma State University's Robert S. Kerr\n\nFood and Agriculture Products Center. The State Department of\n\nHealth shall also have hyperlinks to the Oklahoma Department of\n\nWildlife Conservation's \"Hunters Against Hunger\" webpage, and the\n\nspecial licensing page created by the Oklahoma Department of\n\nAgriculture, Food, and Forestry. The Oklahoma Department of\n\nAgriculture, Food, and Forestry shall also post on its website in a\n\nnew section labeled \"Options for Safe Food Donation\" with hyperlinks\n\nto Section 5.6 of Title 76 of the Oklahoma Statutes, Section 5-601\n\net seq. of Title 2 of the Oklahoma Statutes, Oklahoma Administration\n\nCode Title 310: Chapter 257, 42 U.S.C., Section 1791, to the website\n\nof Oklahoma State University's Robert S. Kerr Food and Agriculture\n\nProducts Center, and the Oklahoma Department of Wildlife\n\nConservation's \"Hunters Against Hunger\" webpage. Additionally, the\n\nOklahoma Department of Agriculture, Food, and Forestry shall have a\n\nwebpage on the special licensing.\n\nC. This section shall apply to all good-faith donations of\n\nperishable or nonperishable food which is not readily marketable due\n\nto appearance, freshness, grade or other conditions.\n\nD. This section shall not restrict the authority of any\n\nappropriate agency to regulate or ban the use of such food for human\n\nconsumption.\n\nE. For purposes of this section:\n\n1. \"Donor\" means any person, profit or nonprofit food\n\ndistributor, or person who harvests perishable foods who makes a\n\ngood-faith donation of food;\n\n2. \"Good-faith donation\" means a gift conferred without\n\ncondition or consideration;\n\n3. \"Charitable organization\" means any benevolent,\n\nphilanthropic, patriotic, eleemosynary, educational, social, civic,\n\nrecreational or religious group or association or any other person\n\nperforming or purporting to perform acts beneficial to the public;\n\n4. \"Nonprofit corporation\" means a corporation formed for a\n\npurpose not involving pecuniary gain to its shareholders or members,\n\npaying no dividends or other pecuniary remuneration, directly or\n\nindirectly, to its shareholders or members as such, and having no\n\ncapital stock; and\n\n5. \"Food\" includes any packaged, prepared, perishable or\n\nnonperishable food item.","path":["OK Code","Title 76"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os76.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d3744e1d6ffb522d3e0fd932455949e0e0f12f7e607f7456a78d86a2573336a6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-76-76-5.5","next":"us-ok/okla.-stat.-tit.-76-76-5.7"},"notice":"GroundRules: Original legal text.
