A licensed architect or professional engineer who\n\nvoluntarily, without compensation other than expense reimbursement,\n\nprovides architectural, structural, electrical, mechanical or other\n\ndesign professional services related to a declared national, state\n\nor local emergency caused by a natural disaster or catastrophic\n\nevent, at the request of or with the approval of a national, state\n\nor local public official, law enforcement official, public safety\n\nofficial or building inspection official believed by the licensed\n\narchitect or professional engineer to be acting in an official\n\ncapacity, shall not be liable for any personal injury, wrongful\n\ndeath, property damage or other loss of any nature related to the\n\nlicensed architect's or professional engineer's acts or omissions in\n\nthe performance of such professional services for any publicly or\n\nprivately owned structure, building, facility, project utility,\n\nequipment, machine, process, piping or other system. Nothing in\n\nthis section shall provide immunity for injury or damage resulting\n\nfrom gross negligence or willful or wanton misconduct in rendering\n\nthe emergency professional services. The immunity provided in this\n\nsection shall apply only to a voluntary architectural or engineering\n\nservice that occurs during the emergency or within ninety (90) days\n\nfollowing the end of the period for an emergency, disaster or\n\ncatastrophic event, unless extended by an executive order issued by\n\nthe Governor under the Governor's emergency executive powers.\n\nB. In the event a natural disaster or catastrophic event\n\ndescribed pursuant to subsection A of this section occurs, and the\n\nservices of licensed architects or professional engineers who\n\nprovide architectural, structural, electrical, mechanical or other\n\ndesign professional services are required, but the number of\n\nprofessional persons licensed or registered in this state is\n\ninsufficient for such purpose, any person licensed or registered in\n\nanother state to practice such profession and who is a member of a\n\nmobile support team or unit of the licensing state, may inspect and\n\nplacard structures for safety and habitability in this state upon\n\nrequest by the Governor of this state and order of the Governor of\n\nthe person's home state without being licensed or registered in this\n\nstate. Out-of-state licensed architects or professional engineers\n\nwho inspect and placard structures for safety and habitability under\n\nthese conditions shall not be liable for any personal injury,\n\nwrongful death, property damage or other loss related to the\n\nlicensed architect's or professional engineer's acts or omissions in\n\nthe performance of such emergency professional services for any\n\npublicly or privately owned structure, building, facility, project\n\nutility, equipment, machine, process, piping or other system.\n\nNothing in this section shall provide immunity for injury or damage\n\nresulting from gross negligence or willful or wanton misconduct in\n\nrendering the emergency professional services. The immunity\n\nprovided in this section shall apply only to a voluntary\n\narchitectural or engineering service of inspecting and placarding\n\nstructures for safety and habitability that occurs during the\n\nemergency or within ninety (90) days following the end of the period\n\nfor an emergency, disaster or catastrophic event, unless extended by\n\nan executive order issued by the Governor of this state under the\n\nGovernor's emergency executive powers.\n\nC. For the purposes of this section:\n\n1. \"Building inspection official\" means any appointed or\n\nelected federal, state or local official with executive\n\nresponsibility to coordinate building inspection in the jurisdiction\n\nin which the emergency or event has occurred;\n\n2. \"Law enforcement official\" means any appointed or elected\n\nfederal, state or local official with executive responsibility to\n\ncoordinate law enforcement in the jurisdiction in which the\n\nemergency or event has occurred;\n\n3. \"Licensed architect\" means a person duly licensed pursuant\n\nto Section 46.1 et seq. of Title 59 of the Oklahoma Statutes;\n\n4. \"Professional engineer\" means a person duly licensed and\n\nregistered pursuant to Section 475.1 et seq. of Title 59 of the\n\nOklahoma Statutes;\n\n5. \"Public official\" means any elected federal, state or local\n\nofficial with executive responsibility in the jurisdiction in which\n\nthe emergency or event has occurred; and\n\n6. \"Public safety official\" means any appointed or elected\n\nfederal, state or local official with executive responsibility to\n\ncoordinate public safety in the jurisdiction in which the emergency\n\nor event has occurred.","path":["OK Code","Title 76"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os76.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ad2e7a3abf01a74f2bff617a17ad166fe0661bc173f88b3d1901cd9b0da1c6c9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-76-76-5.7","next":"us-ok/okla.-stat.-tit.-76-76-5.9"},"notice":"GroundRules: Original legal text.
