Except as provided in subsection B of this section, a\n\nlivestock activity sponsor, a participant or a livestock\n\nprofessional acting in good faith and pursuant to the standards of\n\nthe livestock industry shall not be liable for injuries to any\n\nperson engaged in livestock activities when such injuries result\n\nfrom the inherent risks of livestock activities.\n\nB. 1. The provisions of the Oklahoma Livestock Activities\n\nLiability Limitation Act shall not apply to employees of the sponsor\n\nor livestock professional in the performance of their duties who are\n\ncovered by or subject to the provisions of the workers’ compensation\n\nlaws of Title 85 of the Oklahoma Statutes.\n\n2. Nothing in subsection A of this section shall prevent or\n\nlimit the liability of a livestock activity sponsor, a participant\n\nor a livestock professional, if the livestock activity sponsor, a\n\nparticipant or livestock professional:\n\na. commits an act or omission that constitutes willful or\n\nwanton disregard for the safety of any person engaged\n\nin livestock activities, and that act or omission\n\ncaused the injury,\n\nb. intentionally injures a person engaged in livestock\n\nactivities,\n\nc. provided the equipment or tack, which was faulty, and\n\nsuch equipment or tack was faulty to the extent that\n\nit did cause the injury. The provisions of this\n\nsubparagraph shall not apply to livestock activities\n\nsponsored by youth organizations when youth\n\nparticipants share equipment or tack between\n\nthemselves,\n\nd. provided the livestock and failed to make a reasonable\n\neffort to determine the ability of the participant to\n\nmanage the particular livestock based upon the\n\nparticipant’s representations of such participant’s\n\nability. Provided, however, a participant in a\n\nlivestock show, livestock sale, or rodeo shall be\n\npresumed to be competent in the handling of livestock\n\nif an entry form is required for the activity and\n\nsigned by the participant, or\n\ne. owns, leases, rents or otherwise is in lawful\n\npossession and control of the land or facilities upon\n\nwhich the participant sustained injuries because of a\n\ndangerous condition which was known to the livestock\n\nactivity sponsor, livestock professional or person and\n\nnot made known to the participant.\n\n3. Nothing in subsection A of this section shall prevent or\n\nlimit the liability of a livestock activity sponsor, a participant\n\nor a livestock professional:\n\na. under liability provisions as set forth in the\n\nproducts liability laws, or\n\nb. for livestock activities which result in the death of\n\nany person engaged in livestock activities from the\n\ninherent risks of livestock activities.\n\nC.
