Stat. tit. 76, § 76-53.1","heading":"Exceptions to liability limitations","body":"The provisions of this act do not apply to actions for deceit,\n\nbreach of contract, or expressed or implied warranties, or for\n\ninjuries resulting from failure of firearms to operate in a normal\n\nor usual manner due to defects or negligence in design or\n\nmanufacture. The provisions of this act do not apply to actions\n\narising from the unlawful sale or transfer of firearms, or to\n\ninstances in which the transferor knew, or should have known, that\n\nthe recipient would engage in the unlawful sale or transfer of the\n\nfirearm, or would use, or purposely allow the use of, the firearm in\n\nan unlawful, negligent, or improper fashion. For purposes of this\n\nsection, the potential of a firearm to cause serious injury, damage,\n\nor death as a result of normal function does not constitute a\n\ndefective condition of the product.
