In a product liability action, a manufacturer or seller\n\nshall not be liable if the product is inherently unsafe and known to\n\nbe unsafe by the ordinary consumer who consumes the product with the\n\nordinary knowledge common to the community.\n\nB. The claim that a product is inherently unsafe shall be an\n\naffirmative defense and shall be pled in accordance with the\n\nrequirements of the Oklahoma Pleading Code. In order for the\n\ndefense to apply, all of the following shall be shown:\n\n1. The product was a common consumer product intended for\n\npersonal consumption;\n\n2. The product's utility outweighs the risk created by its use;\n\n3. The risk posed by the product was one known by the ordinary\n\nconsumer who consumes the product with the ordinary knowledge common\n\nto the community;\n\n4. The product was properly prepared and reached the consumer\n\nwithout substantial change in its condition; and\n\n5. Adequate warning of the risk posed by the product was given\n\nby the manufacturer or seller.\n\nC.
