Stat. tit. 76, § 76-82","heading":"Definitions","body":"As used in the Personal Injury Trust Fund Transparency Act:\n\n1. \"Personal injury claim\" means any claim for damages, loss,\n\nindemnification, contribution, restitution or other relief,\n\nincluding punitive damages, that is related to bodily injury or\n\nanother harm, including loss of consortium, society, or\n\ncompanionship, loss of support, personal injury or death, mental or\n\nemotional injury, risk or fear of disease or other injury, or costs\n\nof medical monitoring or surveillance. \"Personal injury claim\"\n\nincludes a claim made by or on behalf of the person who claims the\n\ninjury or harm or by or on behalf of the person's representative,\n\nspouse, parent, minor child, or other relative. \"Personal injury\n\nclaim\" does not include a claim for compensatory benefits pursuant\n\nto crime victim's compensation, workers’ compensation or veteran's\n\nbenefits;\n\n2. \"Personal injury trust\" means a government-approved or\n\ncourt-approved trust, qualified settlement fund, compensation fund\n\nor claims facility created as a result of a federal or state\n\nadministrative or legal action, a court-approved bankruptcy, or\n\npursuant to 11 USC 524(g) or 49 USC 40101, that is intended to\n\nprovide compensation to claimants alleging personal injury claims as\n\na result of harm, also potentially compensable in the immediate tort\n\naction, for which the entity creating the trust, compensation fund,\n\nor claims facility is alleged to be responsible;\n\n3. \"Trust claims materials\" means all documents and information\n\nrelevant or related to a pending or potential claim against a\n\npersonal injury trust. \"Trust claims materials\" include, but are\n\nnot limited to, claims forms and supplementary materials,\n\naffidavits, depositions and trial testimony, work history, and\n\nmedical and health records; and\n\n4. \"Trust governance document\" means any document that\n\ndetermines eligibility and payment levels, including claims payment\n\nmatrices, trust distribution procedures, or plans for\n\nreorganization, for a personal injury trust.","path":["OK Code","Title 76"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os76.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"16b408a4ac3e5114dace8b50fa8b2d9aea47777f48caa9f9b0c491c0efb6fe80","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-76-76-81","next":"us-ok/okla.-stat.-tit.-76-76-83"},"notice":"GroundRules: Original legal text.
