Stat. tit. 78, § 78-21","heading":"Definitions","body":"(A) The term \"trademark\" as used herein means any word, name,\n\nsymbol, emblem, or device or any combination thereof adopted and\n\nused by a person to identify goods made or sold or services rendered\n\nby him and to distinguish them from goods made or sold or services\n\nrendered by others.\n\n(B) The term \"person\" as used herein means any individual, firm,\n\npartnership, corporation, association, union or other organization.\n\n(C) The term \"applicant\" as used herein embraces the person\n\nfiling an application for registration of a trademark under this\n\nact, his legal representatives, successors or assigns.\n\n(D) The term \"registrant\" as used herein embraces the person to\n\nwhom the registration of a trademark under this act is issued, his\n\nlegal representatives, successors or assigns.\n\n(E) For the purposes of this act, a trademark shall be deemed to\n\nbe \"used\" in this state (1) when it is placed in any manner on the\n\ngoods or their containers or on the tags or labels affixed thereto\n\nand such goods are sold or otherwise distributed in this state, or\n\n(2) when it is used in any manner in connection with the sale or\n\nadvertising of services in this state.\n\n(F) The term \"emblem\" as referred to in section (A) shall be\n\ndeemed any badge, motto, button, decoration, charm, rosette or such\n\nother insignia.","path":["OK Code","Title 78"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os78.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1ac6f568061928236c4fe6d45c000f5a3758fc950cafaae0953468112ea4f89b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-78-78-105","next":"us-ok/okla.-stat.-tit.-78-78-22"},"notice":"GroundRules: Original legal text.
