Stat. tit. 78, § 78-22","heading":"Registrability","body":"A trademark by which the goods or services of any applicant for\n\nregistration may be distinguished from the goods of others shall not\n\nbe registered if it\n\n(a) consists of or comprises immoral, deceptive or scandalous\n\nmatter; or\n\n(b) consists of or comprises matter which may disparage or\n\nfalsely suggest a connection with persons, living or dead,\n\ninstitutions, beliefs, or national symbols, or bring them into\n\ncontempt or disrepute; or\n\n(c) consists of or comprises the flag or coat of arms or other\n\ninsignia of the United States, or of any state or municipality, or\n\nof any foreign nation, or any simulation thereof; or\n\n(d) consists of or comprises the name, signature or portrait of\n\nany living individual, except with his written consent; or\n\n(e) consists of a mark which, (1) when applied to the goods or\n\nservices of the applicant, is merely descriptive or deceptively\n\nmisdescriptive of them, or (2) when applied to the goods or services\n\nof the applicant, is primarily geographically descriptive or\n\ndeceptively misdescriptive of them, or (3) is primarily merely a\n\nsurname; provided, however, that nothing in this subsection shall\n\nprevent the registration of a mark used in this state by the\n\napplicant which has become distinctive of the applicant's goods or\n\nservices.
