Subject to the limitations set forth in this title, any\n\nperson who adopts and uses a trademark in this state may file in the\n\nOffice of the Secretary of State, on a form to be furnished by the\n\nSecretary of State, an application for registration of that\n\ntrademark setting forth, but not limited to, the following\n\ninformation:\n\n1. The name and business address of the person applying for the\n\nregistration, and, if a corporation, the state of incorporation;\n\n2. The goods or services in connection with which the mark is\n\nused and the mode or manner in which the mark is used in connection\n\nwith the goods or services and the class in which the goods or\n\nservices are categorized;\n\n3. The date when the trademark was first used anywhere and the\n\ndate when it was first used in this state by the applicant or the\n\npredecessor in business; and\n\n4. A statement that the applicant is the owner of the trademark\n\nand that no other person has the right to use such trademark in this\n\nstate either in the identical form thereof or in such near\n\nresemblance thereto as might be calculated to deceive or to be\n\nmistaken therefor.\n\nB. The application shall be signed by the applicant or by a\n\nmember of the firm or an officer of the corporation or association\n\napplying.\n\nC. The application shall be accompanied by a specimen or\n\nfacsimile of such trademark, which shall be in a form compatible\n\nwith electronic scanning.\n\nD. The application for registration shall be accompanied by a\n\nfiling fee of Fifty Dollars ($50.00), payable to the Secretary of\n\nState.\n\nE.
