Stat. tit. 78, § 78-26","heading":"Assignment","body":"Any trademark and its registration shall be assignable with the\n\ngood will of the business in which the trademark is used, or with\n\nthat part of the good will of the business connected with the use of\n\nand symbolized by the trademark. Assignment shall be by instruments\n\nin writing duly executed and may be recorded with the Secretary of\n\nState upon the payment of a fee of Twenty-five Dollars ($25.00),\n\npayable to the Secretary of State who, upon recording of the\n\nassignment, shall issue in the name of the assignee a new\n\ncertificate for the remainder of the term of the registration or of\n\nthe last renewal thereof.
