Stat. tit. 78, § 78-31","heading":"Infringement","body":"Subject to the provisions of Section 13 hereof, any person who\n\nshall\n\n(a) use, without the consent of the registrant, any\n\nreproduction, counterfeit, copy, or colorable imitation of a\n\ntrademark registered under this act in connection with the sale,\n\noffering for sale, or advertising of any goods on or in connection\n\nwith which such use is likely to cause confusion or mistake or to\n\ndeceive as to the source of origin of such goods; or\n\n(b) reproduce, counterfeit, copy or colorably imitate any such\n\ntrademark and apply such reproduction, counterfeit, copy or\n\ncolorable imitation to labels, signs, prints, packages, wrappers,\n\nreceptacles, or advertisements intended to be used upon or in\n\nconjunction with the sale or other distribution in this state of\n\nsuch goods or services, shall be liable to a civil action by the\n\nowner of such registered trademark for any or all of the remedies\n\nprovided in Section 12 hereof, except that under subsection (b)\n\nhereof the registrant shall not be entitled to recover profits or\n\ndamages unless the acts have been committed with knowledge that such\n\ntrademark is intended to be used to cause confusion or mistake or to\n\ndeceive.","path":["OK Code","Title 78"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os78.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0195ad438283dd5f135d5d74f6c675c87dfc56de6bbab3d48b6462b5b76ef110","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-78-78-30","next":"us-ok/okla.-stat.-tit.-78-78-32"},"notice":"GroundRules: Original legal text.
