Stat. tit. 78, § 78-86","heading":"Definitions","body":"As used in the Uniform Trade Secrets Act, unless the context\n\nrequires otherwise:\n\n1. \"Improper means\" includes theft, bribery, misrepresentation,\n\nbreach or inducement of a breach of a duty to maintain secrecy, or\n\nespionage through electronic or other means.\n\n2. \"Misappropriation\" means:\n\na. acquisition of a trade secret of another by a person\n\nwho knows or has reason to know that the trade secret\n\nwas acquired by improper means; or\n\nb. disclosure or use of a trade secret of another without\n\nexpress or implied consent by a person who:\n\n(1) used improper means to acquire knowledge of the\n\ntrade secret; or\n\n(2) at the time of disclosure or use, knew or had\n\nreason to know that his knowledge of the trade\n\nsecret was:\n\n(a) derived from or through a person who had\n\nutilized improper means to acquire it; or\n\n(b) acquired under circumstances giving rise to\n\na duty to maintain its secrecy or limit its\n\nuse; or\n\n(c) derived from or through a person who owed a\n\nduty to the person seeking relief to\n\nmaintain its secrecy or limit its use; or\n\n(3) before a material change of his position, knew or\n\nhad reason to know that it was a trade secret and that\n\nknowledge of it had been acquired by accident or\n\nmistake.\n\n3. \"Person\" means a natural person, corporation, business\n\ntrust, estate, trust, partnership, association, joint venture,\n\ngovernment, governmental subdivision or agency, or any other legal\n\nor commercial entity.\n\n4. \"Trade secret\" means information, including a formula,\n\npattern, compilation, program, device, method, technique or process,\n\nthat:\n\na. derives independent economic value, actual or\n\npotential, from not being generally known to, and not\n\nbeing readily ascertainable by proper means by, other\n\npersons who can obtain economic value from its\n\ndisclosure or use, and\n\nb. is the subject of efforts that are reasonable under\n\nthe circumstances to maintain its secrecy.","path":["OK Code","Title 78"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os78.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"78d5921874d9f14ac34855bfc40dd112dd9c3c774bed93cb8850e5a003bab300","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-78-78-85","next":"us-ok/okla.-stat.-tit.-78-78-87"},"notice":"GroundRules: Original legal text.
