Stat. tit. 8, § 8-182","heading":"Acquisition of existing cemeteries - Written reports -","body":"Hearings - Determination - Exceptions.\n\n(a) Any corporation, association, individual, partnership,\n\ntrust, or any other organization however constituted which after the\n\neffective date of this act locates or establishes a cemetery,\n\nproviding a grave, vault, columbarium, public mausoleum or other\n\nreceptacle for the burial of dead human remains, in any county of\n\nthe state, shall be subject to the provisions of this act.\n\n(b) No corporation, association, individual, partnership, trust\n\nor any other organization however constituted, shall after the\n\neffective date of this act purchase or acquire, directly or\n\nindirectly, any interest in or the control of an existing cemetery\n\nor property which has been used as a burial ground in any county of\n\nthis state, for the purpose of engaging in the business of the\n\nownership, establishment, maintenance or operation of a cemetery,\n\nproviding a grave, vault, columbarium, public mausoleum or other\n\nreceptacle for the burial of dead human remains, unless and until a\n\nwritten report thereof is made to the board of county commissioners\n\nwherein the cemetery or burial ground is located, and an approval\n\norder is issued by the board to such organization prior to such\n\npurchase or acquisition. The written report shall be made and\n\nsubscribed to by the interested parties, and shall be in such form\n\nand detail as the board shall prescribe and require. In the event\n\nthe board finds, after the written report is made and a hearing held\n\nthereon, that the proposed purchase or acquisition and the\n\nconsummation thereof will result in an evasion or avoidance of this\n\nact in that the organization proposing to so purchase or acquire\n\nintends to substantially change or alter the method or plan of\n\noperation of the cemetery or burial ground, which is hereby declared\n\nto constitute the location and establishment of cemetery after the\n\neffective date of this act, then and in that event the board shall\n\nissue an order disapproving the proposed purchase or acquisition,\n\nand it shall be unlawful for such purchase or acquisition, to be\n\nthereafter consummated unless and until such organization applies\n\nfor and is issued a certificate of authority as provided by Section\n\n3 of this act. In the event the board finds, after the written\n\nreport is made and a hearing held thereon, that the proposed\n\npurchase or acquisition and the consummation thereof will not result\n\nin an evasion or avoidance of this act as hereinbefore provided,\n\nthen and in that event the board shall issue an order approving the\n\nproposed purchase or acquisition and such organization shall not be\n\nrequired to apply for and be issued a certificate of authority as\n\nprovided by Section 3 of this act. This subsection shall not apply\n\nto or affect the inheritance of any interest in or the control of a\n\ncemetery, mausoleum or burial ground.\n\n(c) The provisions of this act shall not apply to a municipal,\n\nreligious, fraternal, rural community, township, state, county and\n\nnonprofit corporate cemeteries and free community burial grounds\n\nwhich are subject to and regulated by Chapters 1, 2, 3, and 5 of\n\nTitle 8, Oklahoma Statutes 1951; nor to cemeteries operated by\n\ncharitable and eleemosynary institutions.\n\n(d) The provisions of this act shall not apply to or affect the\n\npurchase or acquisition by an existing cemetery of additional real\n\nproperty which is immediately adjacent and adjoining to such\n\ncemetery nor to the construction of a mausoleum or columbarium on\n\nthe real property of a cemetery.","path":["OK Code","Title 8"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os8.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4e25669f47d5ec4fb39b64e90b7a8fba991b19e8b581b7ae3f1135545379cbf1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-8-8-181","next":"us-ok/okla.-stat.-tit.-8-8-183"},"notice":"GroundRules: Original legal text.
