After a period of seventy-five (75) years since the last\n\nrecorded activity on a burial space, as defined by the Perpetual\n\nCare Fund Act, and after a reasonable search for heirs and\n\nbeneficiaries, an unused burial site shall be abandoned and the\n\nright of ownership in the burial site shall revert to the private or\n\npublic cemetery, after the cemetery has met the requirements of this\n\nsection.\n\nB. 1. A reasonable search for heirs and beneficiaries pursuant\n\nto this section shall include:\n\na. sending a certified letter of notice by the entity\n\nresponsible for the cemetery to the last-known address\n\nof the record property owner; however, if no address\n\nis available, then no letter shall be required, and\n\nb. publishing a copy of the description of the abandoned\n\nburial space in a newspaper qualified to publish\n\npublic notices pursuant to Section 106 of Title 25 of\n\nthe Oklahoma Statutes in the county of the last-known\n\naddress of the record owner for three (3) weeks;\n\nhowever, if no address is available, then publication\n\nshall take place in the county where the burial space\n\nis located.\n\n2. If no person proves ownership of the burial space within one\n\n(1) year after the publication, the burial space shall be deemed\n\nabandoned for purposes of this section.\n\nC. Any person with a legitimate claim to a burial space that\n\nhas been deemed abandoned pursuant to this section and has been used\n\nor sold by the private or public cemetery shall have the claim\n\nsettled by receiving an equal burial space in an equivalent location\n\nas the burial space that reverted to the private or public cemetery.","path":["OK Code","Title 8"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os8.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fe5be7373b5553778343b1249cb491272a7076385f8b4848d611b69c4878039d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-8-8-187","next":"us-ok/okla.-stat.-tit.-8-8-1a"},"notice":"GroundRules: Original legal text.
