Stat. tit. 8, § 8-215","heading":"Injunction against continuation of business","body":"If the Board is of the opinion upon examination or from other\n\nevidence, that any burial association:\n\n(1) is in an insolvent condition in that it fails and is unable\n\nto provide any burial benefit in accordance with the terms and\n\nconditions of its burial agreement, or\n\n(2) has not complied with its articles of incorporation or\n\nagreement or the provisions of the law applicable to such\n\nassociation, or\n\n(3) is not maintaining its trust fund according to the\n\nprovisions of this act, or\n\n(4) that its condition or management is such as to render its\n\nfurther proceedings or transaction of business hazardous to the\n\npublic, or its members, or to its creditors, or\n\n(5) that its treatment and dealings with its members and\n\nclaimants are not equitable or just, or\n\n(6) has not complied with, or has violated, a written rule or\n\nregulation or order promulgated or issued by the Board, it shall\n\napply to the district court of Oklahoma County, through the Attorney\n\nGeneral of the state, for an injunction restraining the burial\n\nassociation, in whole or in part, from further proceeding with its\n\nbusiness. The court may issue an injunction forthwith and may,\n\nafter notice to the association, and hearing held, make the\n\ninjunction perpetual, and make all orders and decrees needful in the\n\npremises, and may appoint a person designated by the Board to act\n\nfor and in its behalf as receiver to take possession of the property\n\nand effects of the association and to settle its affairs, subject to\n\nsuch rules and orders as the court from time to time may prescribe.","path":["OK Code","Title 8"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os8.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f7e513a688c5ef1fd32aa28563cd2287a102a297959b3f48194b7eea43006faa","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-8-8-214","next":"us-ok/okla.-stat.-tit.-8-8-216"},"notice":"GroundRules: Original legal text.
