The Legislature may review any executive order issued by the\n\nPresident of the United States, federal agency rule or federal\n\ncongressional action to determine the constitutionality of such\n\naction. Upon recommendation from the Legislature, the Attorney\n\nGeneral, through the State Reserved Powers Protection Unit, shall\n\nreview such action by the federal government to determine the\n\nconstitutionality of the action and whether the state should seek an\n\nexemption from the application of the action or seek to have the\n\naction declared unconstitutional by a court of competent\n\njurisdiction and prevent, prohibit or enjoin enforcement of the\n\nunconstitutional order, rule or action.\n\nB. Should the Attorney General decline to pursue action based\n\nupon the determination of the Legislature, the Legislature may by a\n\nmajority vote initiate an action to seek an exemption from the\n\napplication of the action or seek to have the action declared\n\nunconstitutional by a court of competent jurisdiction and prevent,\n\nprohibit or enjoin enforcement of the unconstitutional order, rule\n\nor action.\n\nC. Notwithstanding any other provision of law, the state,\n\ncounty, political subdivision or any other publicly funded\n\norganization shall not implement, adopt or enforce any order,\n\nfederal agency rule or federal congressional action declared\n\nunconstitutional by a court of competent jurisdiction under\n\nsubsection A or B of this section including, but not limited to:\n\n1. Pandemics or other health emergencies;\n\n2. The regulation of natural resources, including oil and\n\nnatural gas;\n\n3. The regulation of the agriculture industry;\n\n4. The use of land;\n\n5. The regulation of the financial sector as it relates to\n\nenvironmental, social or governance standards;\n\n6. The regulation of the constitutional right to keep and bear\n\narms;\n\n7. The regulation of education;\n\n8. The regulation of interscholastic, intramural or other\n\nextracurricular sports sponsored by an institution of higher\n\neducation, a school district or a charter school; or\n\n9.
