The Legislature declares that the purpose of this act is to\n\nensure that law enforcement services are available on United States\n\nmilitary installation property located in this state especially for\n\nthe enforcement of juvenile matters including, but not limited to,\n\ndelinquency, children in need of care, families in need of services,\n\nand any other matters affecting the safety and welfare of juveniles\n\nwithin the state. The Legislature further finds, determines, and\n\ndeclares that this act is necessary for the immediate preservation\n\nof the public peace, health, or safety or for appropriations for the\n\nsupport and maintenance of the departments of the state and state\n\ninstitutions.\n\nB. 1. The State of Oklahoma hereby accepts the relinquishment\n\nof exclusive jurisdiction from the United States pursuant to this\n\nsection. The State of Oklahoma shall have concurrent jurisdiction\n\nwith the United States over the United States military installation\n\nproperty indicated pursuant to this section for as long as the\n\nUnited States controls the property.\n\n2. The concurrent jurisdiction over the United States military\n\ninstallation property pursuant to this section is effective upon the\n\nGovernor’s written acceptance of a request filed by the principal\n\nofficer, or an authorized representative of the United States who\n\nhas supervision or control over the property pursuant to 10 U.S.C.,\n\nSection 2683, of the property where concurrent jurisdiction is\n\nsought, relinquishing exclusive jurisdiction and retaining\n\nconcurrent jurisdiction over the property.\n\n3. The Governor shall not accept a request filed pursuant to\n\nthis section unless the request contains all of the following\n\nrequirements:\n\na. states the name, position, and legal authority of the\n\nperson requesting the cession,\n\nb. unambiguously states the matter for which concurrent\n\njurisdiction is requested,\n\nc. describes by metes and bounds the United States\n\nmilitary installation property subject to the\n\nconcurrent jurisdiction request, and\n\nd. indicates whether the request includes future\n\ncontiguous expansions of land acquired for military\n\npurposes.\n\n4. If the Governor accepts a request pursuant to this section,\n\nthe Governor’s written acceptance shall state the elements of the\n\nrequest that are accepted.\n\n5. If the Governor accepts a request pursuant to this section,\n\nthe Governor shall file the following documents with the Secretary\n\nof State and submit copies of all of the following documents to the\n\nperson who requested concurrent jurisdiction:\n\na. the United States’ request for concurrent\n\njurisdiction,\n\nb. the Governor’s written acceptance of concurrent\n\njurisdiction, and\n\nc. a description by metes and bounds of the United States\n\nmilitary installation property subject to the\n\nconcurrent jurisdiction.\n\nC. Upon request by the United States through an authorized\n\nrepresentative, the governor may execute appropriate documents to\n\naccomplish the cession granted by this section.\n\nD. The state shall not incur or assume any liability as a\n\nresult of accepting concurrent jurisdiction pursuant to this\n\nsection.\n\nE. Upon the establishment of the concurrent jurisdiction\n\npursuant to this section, a state agency or political subdivision\n\nmay, at the sole discretion of the state agency or political\n\nsubdivision, enter into a reciprocal agreement with a United States\n\nagency to designate duties related to the concurrent jurisdiction\n\nbetween the parties. Nothing in this section shall be construed to\n\ncreate any affirmative obligation on the part of a state agency or\n\npolitical subdivision or to require a state agency, local\n\ngovernment, or district to enter into any reciprocal agreement\n\nrelated to the investigation or prosecution of any case, incident,\n\nor allegation.","path":["OK Code","Title 80"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os80.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"cee7d5a480f34dd1057ea1970011fd474bca05a2941dc0e02f7c269785cc1d8a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-80-80-6","next":"us-ok/okla.-stat.-tit.-80-80-7"},"notice":"GroundRules: Original legal text.
