A regular permit is an authorization to put\n\ngroundwater to beneficial use for other than domestic purposes. The\n\nregular permit shall be granted only after completion of the\n\nhydrologic survey and determination of the maximum annual yield for\n\nthe appropriate basin or subbasin. It can be revoked or canceled\n\nonly as provided in Sections 1020.12 and 1020.15 of this title.\n\nB. Temporary Permit.\n\n1. A temporary permit is an authorization for the same purposes\n\nas a regular permit but granted by the Oklahoma Water Resources\n\nBoard prior to completion of the hydrologic survey and the\n\ndetermination of the maximum annual yield of the basin or subbasin.\n\n2. Except as otherwise provided by this subsection, unless\n\nrequested by a majority of the surface owners of the land or by the\n\napplicant, the water allocated by a temporary permit shall not be\n\nless than two (2) acre-feet annually for each acre of land owned or\n\nleased by the applicant in the basin or subbasin. If the applicant\n\npresents clear and convincing evidence that allocations in excess of\n\ntwo (2) acre-feet annually for each acre of land overlying the basin\n\nor subbasin will not exhaust the water thereunder in less than\n\ntwenty (20) years, then the Board may issue temporary permits in\n\nsuch basin or subbasin in such amounts in excess of said limitation\n\nas will assure a minimum twenty-year life for such basin or\n\nsubbasin.\n\n3. A temporary permit must be revalidated annually during its\n\nterm. The permit shall lapse at expiration of its term or upon the\n\nissuance of a regular permit, whichever shall occur first. It is\n\nsubject to revocation or cancellation as provided in Sections\n\n1020.12 and 1020.15 of this title. For temporary permit\n\nrevalidation purposes, water use report forms shall be mailed by the\n\nBoard to each temporary permit holder. Timely return of the\n\ncompleted, signed, and dated water use report form to the Board\n\nshall automatically revalidate a temporary groundwater permit if the\n\nrevalidation is not protested and if the water use report form does\n\nnot show or reflect any permit-water use violations.\n\n4. If the revalidation of a permit is protested, the Board\n\nshall immediately set a date for hearing and notify the applicant\n\nand each protestant of the time and place of the hearing. At the\n\nhearing, any interested person may appear and present evidence and\n\nargument in support of or in opposition to the protest and\n\nrevalidation. At the hearing on the revalidation protest, matters\n\npreviously presented or considered and adjudicated shall not be\n\nsubject to reconsideration or readjudication. The protest issues\n\nwhich may be entertained shall be limited to matters not previously\n\ndetermined, including but not limited to: a material or substantial\n\nchange in conditions since issuance of the permit; evidence of the\n\napplicant's noncompliance with any of the terms, provisions, or\n\nconditions of the permit; or subsequent violations of the Oklahoma\n\nGroundwater Law, or Board rules and regulations.\n\n5. Subject to compliance with all other and applicable\n\nprovisions of this chapter and rules and regulations of the Board,\n\nall temporary permits \"revalidated\" by the Board prior to the\n\neffective date of this act are hereby validated.\n\nC. Special Permit. A special permit is an authorization by the\n\nBoard in lieu of or in addition to a regular or temporary permit.\n\nThe special permit is granted to put groundwater to a beneficial use\n\nwhich shall require quantities of water in excess of that allocated\n\nunder a regular or temporary permit. The water so authorized may be\n\nused only for the purpose designated in the permit. The permit\n\nshall be granted for a period not to exceed six (6) months and may\n\nbe renewed three (3) times. Successive special permits shall not be\n\ngranted for the same purpose. It is subject to revocation or\nwhich shall require quantities of water in excess of that allocated\n\nunder a regular or temporary permit. The water so authorized may be\n\nused only for the purpose designated in the permit. The permit\n\nshall be granted for a period not to exceed six (6) months and may\n\nbe renewed three (3) times. Successive special permits shall not be\n\ngranted for the same purpose. It is subject to revocation or\n\ncancellation upon failure to use the water for the purpose granted\n\nor as provided in Sections 1020.12 and 1020.15 of this title.\n\nD.
