Except as otherwise provided by subsection C of this\n\nsection, any person who, after notice from the Oklahoma Water\n\nResources Board, violates or refuses or neglects to comply with any\n\nprovision of Sections 1020.1 through 1020.21 of this title, or any\n\npermit condition, or of any rule or regulation promulgated by the\n\nBoard pursuant thereto, or who commits waste as defined in Section\n\n1020.15 of this title shall be subject to administrative penalties\n\nissued by the Board. Said penalties shall not exceed Five Thousand\n\nDollars ($5,000.00) per day for each violation and each day such\n\nviolation continues shall constitute a separate violation. Such\n\nadministrative penalties shall be imposed only after notice and\n\nopportunity for hearing on the proposed imposition of such\n\npenalties.\n\nB. In addition to administrative penalties, except as otherwise\n\nprovided by subsection C of this section, any person who, after\n\nnotice from the Board, violates or refuses or neglects to comply\n\nwith any provision of Sections 1020.1 through 1020.21 of this title,\n\nor of any rule or regulation promulgated by the Board pursuant\n\nthereto, or who commits waste as defined in Section 1020.15 of this\n\ntitle shall be guilty of a misdemeanor, and upon conviction shall be\n\nfined not less than Twenty-five Dollars ($25.00) nor more than One\n\nThousand Dollars ($1,000.00) for each offense. Any person who,\n\nafter notice that he or she is in violation thereof continues to\n\nviolate any provision of Sections 1020.1 through 1020.21 of this\n\ntitle, and fails to comply therewith within a reasonable length of\n\ntime, is guilty of a separate offense for each day the violation\n\ncontinues.\n\nC.
