The ability to take and use marginal water has the potential\n\nto augment water supply in many areas of Oklahoma. Therefore, the\n\ntaking and use of marginal water in accordance with the Oklahoma\n\nGroundwater Law and the rules of the Oklahoma Water Resources Board\n\nshall be considered a beneficial use and not waste. Except as\n\nprovided for in this section and Sections 1020.15 and 1020.16 of\n\nTitle 82 of the Oklahoma Statutes, the provisions of this act shall\n\nnot apply to the taking and use of marginal water.\n\nB. The Oklahoma Water Resources Board shall promulgate and\n\nimplement rules for the taking and use of marginal water, including\n\nthe well construction standards, well spacing, and water use\n\nreporting. Rules related to well construction standards shall\n\nensure that the taking and use of marginal water shall not impair\n\nany fresh water basins, and shall include, but not be limited to,\n\nthe rate of withdrawal, the level of perforating and the level of\n\nsealing the well.\n\nC. Any use of marginal water under this section is in addition\n\nto any domestic use authorized under Section 1020.3 of Title 82 of\n\nthe Oklahoma Statutes or any other use authorized pursuant to a\n\npermit issued under Section 1020.11 of Title 82 of the Oklahoma\n\nStatues.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"079be793f1c42715494fcd283843cd4d61efffd4ad99c8b1d0842ddc8ae38ac9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-1020.22","next":"us-ok/okla.-stat.-tit.-82-82-1020.2a"},"notice":"GroundRules: Original legal text.
