Except as otherwise provided by Section 1020.10 of this\n\ntitle for limited quantity groundwater permits, upon the filing of\n\nan application which complies with the provisions of Chapter 11 of\n\nthis title, and the rules promulgated by the Oklahoma Water\n\nResources Board pursuant thereto, the Board shall instruct the\n\napplicant to provide notice thereof, at the applicant's expense, and\n\nas required by the Board's rules. Such notice shall give all the\n\nessential facts as to the proposed taking, among them being the\n\nplaces of taking and of use, amount of water, the purpose for which\n\nit is to be used, name and address of applicant, the hearing date,\n\ntime and place if a hearing is scheduled by the Board before\n\ninstructions to provide notice are given, and a thirty-day protest\n\nperiod as well as the manner in which a protest to the application\n\nmay be made. At the time the Board provides notice of application\n\nto the applicant, the Board shall publish on its website the\n\napplications and instructions for public notice, including the draft\n\npublic notice prepared by the Board. The website publishing is in\n\naddition to, and not in lieu of, the requirement for applicants to\n\npublish notice in the newspaper. The time to protest shall run from\n\nthe date of the first newspaper publication.\n\nB. No hearing shall be had upon the application until proper\n\nnotice shall have been given. Any interested party shall have the\n\nright to protest the application and present evidence and testimony\n\nin support of such protest. If the Board does not schedule a\n\nhearing on the application before instructing the applicant to\n\nprovide notice, a hearing on the application shall be scheduled by\n\nthe Board upon receipt of a protest which meets the requirements of\n\nthe Board's rules and the Board shall notify the applicant and\n\nprotestant of such hearing.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b6c3c005378c7d41ae219912de90c0f483f300a545df94041e65bb3add2674fb","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-1020.7","next":"us-ok/okla.-stat.-tit.-82-82-1020.9"},"notice":"GroundRules: Original legal text.
