The unauthorized use of water, the unauthorized transfer of\n\na water right, the continued use of works which are unsafe after\n\nreceiving notice to repair, the waste of water, the unauthorized\n\nseverance of a water right from the land to which it is appurtenant,\n\nthe refusal to change unsafe works when directed to do so, the\n\ninjury or obstruction of waterworks, or the violation of a permit\n\ncondition shall be a misdemeanor and each day such violation\n\ncontinues shall be a separate violation. In addition to filing\n\ncriminal complaints and any other remedies provided herein, the\n\nOklahoma Water Resources Board shall have the right to bring an\n\naction in the district court of the county wherein such act or\n\nomission occurs to enjoin the same.\n\nB. The unauthorized use of water, the unauthorized transfer of\n\na water right, the continued use of works which are unsafe after\n\nreceiving notice to repair, the waste of water, the unauthorized\n\nseverance of a water right from the land to which it is appurtenant,\n\nthe refusal to change unsafe works when directed to do so, the\n\ninjury or obstruction of waterworks, or the violation of a permit\n\ncondition are considered violations of Sections 105.1 through 105.32\n\nof this title and shall be subject to administrative penalties\n\nissued by the Board of up to Five Thousand Dollars ($5,000.00) per\n\nday of violation. Such administrative penalties shall be imposed\n\nonly after notice and opportunity for hearing on the proposed\n\nimposition of such penalties.\n\nC. The Board and its authorized agents shall have a reasonable\n\nright to go upon private property in the performance of their duties\n\nhereunder and shall have the duty to file complaints of violations\n\nof the penal provisions of this section.\n\nD. Notwithstanding any other provision of law, the Executive\n\nDirector of the Oklahoma Water Resources Board may issue\n\nadministrative orders requiring the immediate cessation of water use\n\nwhen Board staff has a reasonable belief the use is unauthorized or\n\ncontinued use will damage rights of prior appropriators. Such\n\nadministrative orders shall indicate the finding of imminent peril\n\nand shall specify the actions that are to be taken immediately.
