Stat. tit. 82, § 82-105.5","heading":"Impairment of water rights - Suits in district court","body":"Any person having a right to the use of water from a stream as\n\ndefined by this act or Section 60 in Title 60 of the Oklahoma\n\nStatutes whose right is impaired by the act or acts of another, or\n\nothers, may bring suit in the district court of any county in which\n\nany of the acts complained of occurred. Provided, however, that\n\nnothing herein contained shall be construed to empower district\n\ncourts to recognize rights to use the water of a stream unless such\n\nrights have heretofore been established pursuant to this act or are\n\nclaimed under Section 60 in Title 60 of the Oklahoma Statutes.\n\nProvided, however, that the Attorney General shall intervene on\n\nbehalf of the state in any suit for the adjudication of rights to\n\nthe use of water if notified by the Board that the public interests\n\nwould be best served by such action.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c87c8a7df7a071f256b924959a484f2502e988fde3dde12c24a800fa99e38a1b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-105.4","next":"us-ok/okla.-stat.-tit.-82-82-105.6"},"notice":"GroundRules: Original legal text.
