Stat. tit. 82, § 82-1085.39","heading":"Grants - Grant account - Rules and regulations -","body":"Disposition of investment income - Legal counsel.\n\nIn furtherance of the purposes of Sections 1085.31 through\n\n1085.49 of this title:\n\n1. The Oklahoma Water Resources Board shall administer grants\n\nfrom any monies which may be available to the Water Resources Fund\n\nfor furtherance of the purposes of Sections 1085.31 through 1085.49\n\nof this title to eligible entities of the state with such conditions\n\nas shall in its discretion effectuate these purposes. For purposes\n\nof carrying out and implementing the provisions of this section,\n\nthere is hereby created and established within the Water Resources\n\nFund a grant account which shall contain such monies as may be\n\navailable for purposes of carrying out the provisions of this\n\nsection. No more than ten percent (10%) of such grants shall be\n\nused for planning purposes. All such eligible entities are hereby\n\nauthorized to accept grants from the Board. No grant shall be made\n\nto any single eligible entity during any fiscal year in an amount\n\nexceeding twenty percent (20%) of the funds available for grants to\n\neligible entities during that fiscal year nor shall such grant\n\nexceed Three Hundred Thousand Dollars ($300,000.00). In the case of\n\nprojects to which more than one eligible entity is a party, no such\n\ngrant shall be made exceeding in amount twenty percent (20%) of\n\nfunds available for such purposes per participating eligible entity\n\nnor shall such grant exceed Three Hundred Thousand Dollars\n\n($300,000.00) per participating entity. In making such grants, the\n\nBoard shall consider: The needs of the area to be served by the\n\nproject and the benefit of the project to the area in relation to\n\nthe needs of other areas requiring state assistance; the\n\navailability of revenue to the political subdivision, from all\n\nsources, for the ultimate repayment of the cost of the project,\n\nincluding interest; whether the political subdivision can reasonably\n\nfinance the project without assistance from the state; and the\n\nrelationship of the project to the overall statewide water and\n\nsewage treatment needs; and whether or not the applicant has taken\n\nall reasonable measures to limit waste and conserve water;\n\n2. The Board shall prescribe such rules and regulations as may\n\nbe necessary for determining the eligibility and priority of\n\napplicants for loans and grants and devise rules and regulations to\n\ninsure fair and equitable distribution of said loans and grants; and\n\npromulgate and adopt such rules and regulations as may be necessary\n\nfor purposes of expenditures and payments. Provided, no grant of\n\nfunds shall be made unless such grant is necessary to assist public\n\nbodies in emergency situations. Provided also priorities for use of\n\nloan and grant money for a particular project shall be established\n\nby the state agency with primary responsibility. Provided further,\n\nthat the Board shall not adopt any rule, regulation or condition\n\nrequiring that a particular attorney or law firm be employed by any\n\neligible entity in connection with such entity's grants or loans\n\nfrom the Board; and\n\n3. The Board is hereby authorized to direct that up to fifty\n\npercent (50%) of the interest income from the investment of monies\n\nin the Statewide Water Development Revolving Fund and the Water\n\nResources Fund Grant Account accruing from and after the date of\n\nthis act be deposited in the Statewide Water Development Revolving\n\nFund created under Section 1085.40 of this title.\n\nThe Board may adopt reasonable nondiscriminatory standards for\n\nselection of legal counsel.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0d8c530f821e43d7cc5e3fbbcb0833c1a739c47679b573958878e7f16314a6a1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-1085.38","next":"us-ok/okla.-stat.-tit.-82-82-1085.4"},"notice":"GroundRules: Original legal text.
