The Oklahoma Conservation Commission shall promulgate rules\n\nto receive, and review applications for water quality projects\n\nsubmitted to the Clean Water State Revolving Fund Program for\n\nimplementation of nonpoint source management programs as allowed by\n\nthe federal Water Quality Act of 1987 for those activities subject\n\nto its jurisdiction as specified in the Oklahoma Environmental\n\nQuality Act.\n\nB. The rules shall require that to be eligible for financial\n\nassistance, the proposed project:\n\n1. Meets or will meet a critical local or state need, as\n\ndefined in the State Nonpoint Source Assessment and Management\n\nReport;\n\n2. Is needed or will be needed to comply with the State\n\nNonpoint Source Assessment and Management Report;\n\n3. Is designed to prevent, reduce or halt the pollution of the\n\nwaters of this state and comply with Oklahoma's Water Quality\n\nStandards;\n\n4. Is cost-effective; and\n\n5. Shall be awarded upon a cost-share basis.\n\nC. The Commission shall consult with and obtain comments of the\n\nExecutive Director of the Department of Environmental Quality prior\n\nto making a recommendation on all applications and programs which\n\nmay involve nonpoint sources subject to the jurisdiction of the\n\nDepartment of Environmental Quality. The Department of\n\nEnvironmental Quality's comments shall be addressed in the\n\nrecommendation or attached thereto.\n\nD.
