In addition to other powers and duties provided by law, the\n\nDepartment of Environmental Quality shall have the power and duty\n\nto:\n\n1. Prepare and maintain the priority list for treatment works;\n\n2. Review and assess the planning documents for and cost\n\neffectiveness of drinking water treatment projects on the priority\n\nlist;\n\n3. Determine drinking water treatment project feasibility and\n\nthe entities' eligibility to receive funding from the Drinking Water\n\nTreatment Revolving Loan Account;\n\n4. Determine which projects should be referred to the Board for\n\nloans from the Drinking Water Treatment Revolving Loan Account;\n\n5. Perform any required environmental review and make any\n\nrequired environmental determinations in accordance with any\n\nnecessary environmental review process approved by the Environmental\n\nProtection Agency;\n\n6. Provide oversight and technical assistance during the\n\nplanning, design, and construction phase of the drinking water\n\ntreatment project for which the entity is applying for such loan;\n\n7. Be the instrumentality to make application to the\n\nEnvironmental Protection Agency for the capitalization grant and\n\nenter into the capitalization grant agreement, and be the recipient\n\nof the capitalization grant; and\n\n8. Assess the technical capability of an applicant to ensure\n\ncompliance with the federal Safe Drinking Water Act over the long\n\nterm.\n\nB. In determining the cost effectiveness of any drinking water\n\ntreatment project, the Department shall require the preparation of a\n\ncost effective analysis of feasible drinking water treatment or\n\nconveyance alternatives capable of meeting state and federal\n\ndrinking water standards and public health requirements while\n\nrecognizing environmental and other nonmonetary considerations\n\ndetermined to be relevant by the Department.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2691ba05a74a1a9d2368b275fbc4014a64f29395065321ee2b39814c11084577","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-1085.74","next":"us-ok/okla.-stat.-tit.-82-82-1085.76"},"notice":"GroundRules: Original legal text.
