Stat. tit. 82, § 82-110.5","heading":"Oklahoma Water Resources Board - Powers and duties","body":"The Oklahoma Water Resources Board, in addition to other powers\n\nand duties as provided by law, shall have the following powers and\n\nduties:\n\n1. To promulgate rules necessary to carry out the provisions of\n\nthis act, including but not limited to rules relating to hazard and\n\nsize classifications, minimum standards for design, operation and\n\nmaintenance of dams, and fee schedules for inspections and other\n\nservices provided to carry out the dam safety program authorized by\n\nthis act;\n\n2. To review and grant or deny applications to approve plans\n\nand specifications for construction of new dams and modifications of\n\nexisting dams, based on the applicable minimum standards adopted\n\nprovided that an owner who proposes to construct a new dam\n\nclassified as having a low hazard potential that will be used\n\nprimarily for agriculture purposes, and will be designed or\n\nconstructed with the assistance of a local conservation district or\n\nfederal agriculture related agency, shall be required only to notify\n\nthe Board of such construction;\n\n3. To supervise and oversee construction of new dams and\n\nmodifications of existing dams;\n\n4. To inspect existing dams and dams under construction in\n\naccordance with the following requirements:\n\na. dams classified as having a high hazard potential\n\nshall be inspected at least once annually,\n\nb. dams classified as having a significant hazard\n\npotential shall be inspected at least once every three\n\n(3) years, and\n\nc. dams classified as having a low hazard potential shall\n\nbe inspected at least once every five (5) years;\n\nprovided, that the Board shall accept an inspection report of a\n\nregistered professional engineer having practical experience in the\n\nanalysis, design and construction of dams and employed or retained\n\nby the owner for dams classified as high or significant hazard\n\npotential, or by an engineer employed by any United States\n\ngovernmental agency acting in an official capacity, and provided\n\nfurther, for dams classified as low hazard potential, the Board may\n\nexempt such inspections as set forth in its rules and may accept an\n\ninspection report of a person trained in inspecting dams and who is\n\nemployed or retained by the owner. Fees for such inspections\n\nconducted by the Board and for reviewing inspection reports prepared\n\nby others shall be as set forth in rules promulgated by the Board;\n\n5. To require maintenance, repairs and modifications of\n\nexisting dams as necessary, including compliance schedules, so that\n\nminimum standards can be met;\n\n6. To have reasonable access to public and private property for\n\nthe purpose of inspecting and investigating conditions related to\n\ndams and to require that records of owners of dams be inspected and\n\ncopied;\n\n7. To cooperate with agencies of federal, state and local\n\ngovernments and private persons, including but not limited to the\n\nOklahoma Conservation Commission and local conservation districts,\n\nin carrying out its duties under this act;\n\n8. To disseminate information about the dam safety program; and\n\n9.
