Stat. tit. 82, § 82-1102","heading":"Creation of authority - Joint authorities - Status -","body":"Dissolution - Limitation on obligations.\n\n(a) There is hereby established in each incorporated city and\n\ntown and in each county of the state a public body corporate and\n\npolitic which shall be an agency of the State of Oklahoma and shall\n\nbe known as the \"port authority\" of the city or town or of the\n\ncounty. Port authorities created in this act may be combined to\n\nform joint port authorities by cooperative agreement executed by the\n\ngoverning bodies of any city or county or cities or counties. Such\n\njoint authorities formed by such cooperative agreement shall have\n\nall the powers and jurisdiction enumerated in this act. The\n\nauthority shall not transact any business or exercise its powers\n\nhereunder until or unless the governing body of the city or town by\n\nappropriate ordinance, or the county by appropriate resolution,\n\ndeclares that there is need for an authority to function in the\n\ncity, town, or county. No member of said authority shall serve as\n\nsuch who owns land, other than a residence, or represents in a\n\nfiduciary capacity or as agent any person who owns land located in\n\nan area within five (5) miles of lands surveyed or examined for port\n\nlocations. Any member of said authority who has any interest which\n\nwill conflict with the interests of the authority shall be subject\n\nto removal. Any member of the authority owning lands or having\n\nlands under his control as agent or in a fiduciary capacity in an\n\narea surveyed or examined for port location shall be deemed to have\n\na conflict of interest and subjected to removal, except this\n\nlimitation or membership and conflict of interest shall not apply\n\nwhere the site of a port has been presently engineered and\n\ndesignated by a port authority already organized under this act. A\n\nport authority created hereunder shall be a body corporate and\n\npolitic which may sue and be sued, plead and be impleaded, and shall\n\nhave the powers and jurisdiction enumerated in Sections 1 to 14,\n\ninclusive, of this act. The exercise by such port authority of the\n\npowers conferred upon it shall be deemed to be essential\n\ngovernmental functions of the State of Oklahoma, but no port\n\nauthority shall be immune from liability by reason thereof.\n\n(b) Any municipal corporation or county creating or\n\nparticipating in the creation of a port authority in accordance with\n\nthis act may expend funds not otherwise appropriated to defray the\n\nexpense of surveys and examinations incidental to the purposes of\n\nthe port authority so created and may appropriate to the authority\n\nany available funds not otherwise appropriated for expenditure by\n\nthe authority for any purpose authorized by this act.\n\n(c) Subject to making due provisions for payment and performance\n\nof its obligations, a port authority may be dissolved by the\n\nsubdivision or subdivisions creating it, and in such event the\n\nproperties of the port authority shall be transferred to the\n\nsubdivision creating it, or, if created by more than one\n\nsubdivision, to the subdivisions creating it in such manner as may\n\nbe agreed upon between such subdivisions. Obligations of the\n\nauthority shall not be obligations of the State of Oklahoma, nor of\n\nany city, town, or county which creates said authority, unless said\n\nobligations are specifically accepted by a majority vote of the ad\n\nvalorem taxpaying registered voters of such city, town, or county\n\nvoting on the issue. Notice of such election shall be published at\n\nleast once a week for two successive weeks in a newspaper of general\n\ncirculation in the county, the first publication thereof to be at\n\nleast ten (10) days prior to said election.
