Stat. tit. 82, § 82-1106","heading":"Port authority - Powers","body":"A port authority established pursuant to Section 1101 et seq. of\n\nthis title shall have full power and authority to:\n\n1. Purchase, construct, reconstruct, sell, lease, operate, and\n\notherwise contract concerning docks, wharves, warehouses, piers, and\n\nother port, terminal, industrial, or transportation facilities\n\nwithin its jurisdiction consistent with the purposes of the port\n\nauthority, and to make charges for the use thereof;\n\n2. Borrow money from either public or private financial\n\ninstitutions, sources or any agency of the State of Oklahoma or of\n\nthe United States of America, and to issue therefor such notes or\n\nother evidence of indebtedness as may be required and to mortgage,\n\npledge, or otherwise encumber the assets of the authority as\n\nsecurity therefor;\n\n3. Apply for, receive, and participate in any grants from the\n\nState of Oklahoma or from the United States of America;\n\n4. Straighten, deepen, improve, construct, reconstruct, or\n\nextend any canal, channel, river, stream, basin, or other\n\nwatercourse or way which may be necessary or proper in the\n\ndevelopment of the facilities of the port;\n\n5. Acquire, own, hold, sell, lease, operate, or otherwise\n\ncontract concerning real or personal property for the authorized\n\npurposes of the port authority;\n\n6. Acquire, own, maintain, sell, or lease land within its\n\njurisdiction as it may deem desirable for the development, planning,\n\nconstruction, operation, or leasing of land or completed industrial\n\nfacilities for industrial use which is hereby declared to be for a\n\npublic purpose;\n\n7. Apply to the proper authorities of the United States\n\npursuant to appropriate law for the right to establish, operate, and\n\nmaintain foreign trade zones within the limits prescribed by the\n\nUnited States Foreign Trade Zones Board and to establish, operate,\n\nand maintain such foreign trade zones;\n\n8. Exercise the right of eminent domain to appropriate any\n\nland, rights, rights-of-way, franchises, easements, or other\n\nproperty, necessary or proper for the construction or the efficient\n\noperation of any facility of the port authority and included in its\n\nofficial plan, pursuant to the procedure provided by law for\n\nrailroad companies, if funds equal to the appraised value of the\n\nproperty to be acquired as the result of such proceedings shall be\n\non hand and available for such purposes, except that nothing\n\ncontained in Sections 1101 to 1114, inclusive, of this title shall\n\nauthorize a port authority to take or disturb property or facilities\n\nbelonging to any public corporation, public utility, or common\n\ncarrier, which property or facilities are necessary and convenient\n\nin the operation of the public corporation, public utility, or\n\ncommon carrier, unless provision is made for the restoration,\n\nrelocating, or duplication of such property or facilities, or upon\n\nthe election of such public corporation, public utility, or common\n\ncarrier for the payment of compensation, if any, at the sole cost of\n\nthe port authority; provided that:\n\na. if any restoration or duplication proposed to be made\n\nhereunder shall involve a relocation of property or\n\nfacilities, the new facilities and location shall be\n\nof at least comparable utilitarian value and\n\neffectiveness and relocation shall not impair the\n\nability of the public utility or common carrier to\n\ncompete in its original area of operation,\n\nb. if any restoration or duplication made hereunder shall\n\ninvolve a relocation of such property or facilities,\n\nthe port authority shall acquire no interest or right\n\nin or to the appropriated property or facilities,\n\nexcept as provided in paragraph 3 of this section,\n\nuntil the relocated property or facilities are\n\navailable for use and until marketable title thereto\n\nhas been transferred to the public utility or common\n\ncarrier, and\nde hereunder shall\n\ninvolve a relocation of such property or facilities,\n\nthe port authority shall acquire no interest or right\n\nin or to the appropriated property or facilities,\n\nexcept as provided in paragraph 3 of this section,\n\nuntil the relocated property or facilities are\n\navailable for use and until marketable title thereto\n\nhas been transferred to the public utility or common\n\ncarrier, and\n\nc. provisions for restoration or duplication shall be\n\ndescribed in detail in the resolution for\n\nappropriation passed by the port authority;\n\n9. Maintain such funds as it deems necessary;\n\n10. Direct its agents or employees, when properly identified in\n\nwriting, and after at least five (5) days' written notice, to enter\n\nupon lands within the confines of its jurisdiction in order to make\n\nsurveys and examinations preliminary to location and construction of\n\nworks for the purposes of the port authority, without liability of\n\nthe port authority or its agents or employees except for actual\n\ndamage done;\n\n11. Sell or lease real and personal property not needed for the\n\noperation of the port authority and grant easements or rights-of-way\n\nover property of the port authority;\n\n12. Promote, advertise, and publicize the port and its\n\nfacilities, provide traffic information and rate information to\n\nshippers and shipping interests, and appear before rate making\n\nauthorities to represent and promote the interests of the port;\n\n13. Repay grants or loans made prior to the effective date of\n\nthis act where the funds have been expended for a proper purpose of\n\nthe authority as originally authorized; and\n\n14. Enter into cooperative agreements with one or more other\n\nport authorities to exercise any of the powers or to perform any of\n\nthe duties conferred by this section.
