Public construction contracts as such term is defined by the\n\nPublic Competitive Bidding Act of 1974 and executed by a port\n\nauthority created pursuant to Section 1102 of this title shall be\n\nsubject to the Public Competitive Bidding Act of 1974.\n\nB. 1. Except as otherwise provided by subsection C of this\n\nsection, no sale of any real property or personal property having a\n\nfair market value exceeding the public construction contract amount\n\nspecified by the Public Competitive Bidding Act of 1974 shall be\n\nmade by the port authority unless notice calling for bids for the\n\ncontract has been given by publication as provided by Section 1101\n\nof this title.\n\n2. No sale of real property or personal property shall be made\n\nexcept to the highest responsible bidder.\n\n3. In the case of any sale of land by the port authority\n\nrequiring competitive bids, specifications for the bids for the sale\n\nshall be in such form and detail as is determined by the port\n\nauthority. Provided, however, if the port authority finds that an\n\nimmediate emergency exists, which findings shall be entered in the\n\nminutes of the port authority, by reason of which an expenditure in\n\nan amount exceeding the public construction contract amount\n\nspecified by the Public Competitive Bidding Act of 1974 is necessary\n\nin order to avoid loss of life, substantial damage to property, or\n\ndamage to the public peace or safety, then such contracts may be\n\nexecuted without public notice or competitive bids.\n\nC. Competitive bids shall not be required for the sale of real\n\nproperty or personal property by a port authority if:\n\n1. The real property or personal property is to be sold for\n\nindustrial development purposes;\n\n2. The real property or personal property was acquired by the\n\nport authority for industrial development purposes; and\n\n3. The contract for the sale of the real property or personal\n\nproperty has been approved by the board of directors of such port\n\nauthority.\n\nD. Every public construction contract or contract for the sale\n\nof real property or personal property shall be executed in writing.\n\nIf the public construction contract involves work or construction,\n\nthe contract shall be accompanied by or shall refer to plans and\n\nspecifications for the work to be done, prepared for and approved by\n\nthe port authority, signed by the chairman of the port authority and\n\nby the contractor, and shall be executed in triplicate.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2bf069e103fff5d530ad1812827e4a00d9f07399b5142ba8dbe1f10b3c14dc3d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-1111","next":"us-ok/okla.-stat.-tit.-82-82-1113"},"notice":"GroundRules: Original legal text.
