Stat. tit. 82, § 82-1142","heading":"Tri-State Commission on the McClellan-Kerr Arkansas River","body":"Navigation System (MKARNS) – Creation - Duties.\n\nA. There is hereby created the Tri-State Commission on the\n\nMcClellan-Kerr Arkansas River Navigation System (MKARNS). It is\n\nanticipated that the State of Arkansas and the State of Kansas will\n\nenact legislation in order to complete the formation of the\n\nCommission.\n\nB. The Oklahoma membership of the Tri-State Commission shall be\n\nas follows:\n\n1. One member appointed by the Governor who shall be a member\n\nof the Water Advisory Board of the Department of Transportation;\n\n2. Three members of the House of Representatives whose\n\nlegislative districts encompass some part of the territory in which\n\nthe MKARNS is located to be formally selected by the Speaker of the\n\nHouse of Representatives; provided, whenever possible, no more than\n\ntwo members shall be appointed from the same political party;\n\n3. Three members of the Senate whose legislative districts\n\nencompass some part of the territory in which the MKARNS is located\n\nto be formally selected by the President Pro Tempore of the Senate;\n\nprovided, whenever possible, no more than two members shall be\n\nappointed from the same political party;\n\n4. One member from each of the three Native American tribes\n\nthat has ownership interest in the Arkansas riverbed;\n\n5. One member appointed by the Speaker of the House of\n\nRepresentatives who shall represent a statewide business\n\norganization;\n\n6. One member appointed by the President Pro Tempore of the\n\nSenate who shall represent a statewide agricultural organization;\n\nand\n\n7. One member appointed by the Governor who shall represent a\n\npublic port along the MKARNS.\n\nC. The Tri-State Commission shall have the following duties:\n\n1. To identify the resources available at the federal and state\n\nlevels for the proper maintenance of the physical assets which allow\n\nthe MKARNS to fulfill its duties and responsibilities;\n\n2. To identify methods for the repair, replacement or\n\nmaintenance of the infrastructure assets which are essential to the\n\noperation of the MKARNS;\n\n3. To prioritize the funding, whether from the federal\n\ngovernment, state government, tribal governments, private resources\n\nor other financial resources, in order to adequately maintain the\n\nMKARNS;\n\n4. To take such actions as may be necessary to promote the\n\nMKARNS and its continued role in the economies of the states of\n\nOklahoma, Arkansas and Kansas;\n\n5. To take such actions as are conducive to the continued use\n\nand enhanced use of the MKARNS by for-profit business enterprises in\n\norder to reduce transportation costs, improve profit margins,\n\nincrease efficiency and related economic benefits;\n\n6. To take such actions as are conducive to the continued vital\n\nrole of the MKARNS with respect to flood control in the three\n\naffected states;\n\n7. To take such actions as are conducive to the promotion of\n\nthe MKARNS for purposes of tourism and cultural preservation;\n\n8. To take such other actions as may be necessary which in the\n\njudgment of the Tri-State Commission would be beneficial for the\n\nthree affected states and for the MKARNS; and\n\n9.
