Two or more counties, by interlocal agreement made pursuant\n\nto the provisions of the Interlocal Cooperation Act and in\n\naccordance with the provisions of Sections 1266 through 1288 of this\n\ntitle, may establish a regional water district to carry out\n\nactivities and projects authorized by this act. The agreement under\n\nwhich the district is formed shall provide for the establishment of\n\na board of directors to govern the affairs of the district. Each\n\npublic agency which is a member of the district shall have one\n\nmember on said board appointed by the board of county commissioners\n\nof the county where the public agency has its principal office.\n\nEach member appointed shall be a member of the governing body of the\n\nparticipating public agency. Said agreement shall further provide\n\nfor staggered terms for board members not to exceed three (3) years.\n\nB. In addition to the requirements of subsection (c) of Section\n\n1004 of Title 74 of the Oklahoma Statutes, an interlocal agreement\n\nestablishing a regional water district shall also contain the\n\nfollowing:\n\n1. An accurate description of the territory which it is\n\nproposed shall be embraced within the district, and a map of such\n\nterritory shall be attached to the agreement as an exhibit thereto;\n\n2. A brief and concise statement describing the purpose of the\n\ndistrict and its proposed activities or projects, in general terms;\n\n3. A brief and concise statement showing the necessity for\n\nforming and operating the proposed district, describing the benefits\n\nto be received therefrom by the persons and public agencies in the\n\nterritory proposed to be embraced in the district;\n\n4. The proposed name for the district;\n\n5. The proposed location of the principal office of the\n\ndistrict;\n\n6. Such other and additional information as may be appropriate\n\nand useful in the agreement;\n\n7. A statement by the State Board with the results of its\n\nreview as to the following:\n\na. the availability and dependability of water rights and\n\nthe quantity of water available to undertake the\n\nactivities and to provide the benefits described in\n\nparagraph 3 of subsection B of this section; and\n\nb. the absence of conflict of the proposed district and\n\nits activities with the comprehensive water plan of\n\nthe state;\n\n8. A statement by the Department of Environmental Quality with\n\nthe results of its review as to the quality of water, in accordance\n\nwith safe drinking water standards, which is proposed to be used by\n\nthe district to undertake the activities and to provide the benefits\n\ndescribed in paragraph 3 of subsection B of this section;\n\n9. The terms and conditions of eligibility for initial\n\nmembership in the district, for new members seeking to join the\n\ndistrict, and for withdrawal by a signatory public agency from the\n\ndistrict; and\n\n10. A statement providing that water rights cannot be acquired\n\nby eminent domain.\n\nC. The interlocal agreement after being executed by appropriate\n\nresolution of the governing bodies of the member public agencies,\n\nand the materials required by subsection B of this section, shall be\n\nsubmitted to the Attorney General as required by the Interlocal\n\nCooperation Act.
