Stat. tit. 82, § 82-1283","heading":"Contracts and agreement for purchase of district services","body":"or products.\n\nA. In order to accomplish the purposes of this act, any public\n\nagency, subject to any applicable restrictions of Article X,\n\nSections 17, 26 and 27 of the Constitution of the State of Oklahoma,\n\nmay enter into and carry out contracts and agreements for the\n\npurchase from the district of water, sewage and any other services\n\nor products of the district.\n\nB. Each such contract and agreement for the provision of water,\n\nsewer or any other services to an existing public agency shall be\n\nfor such period and shall contain such other terms, conditions and\n\nprovisions, not inconsistent with the provisions of this act, as the\n\nboard of directors shall approve.\n\nC. Each such contract and agreement may be pledged by the\n\ndistrict to secure its obligations and may provide that if one or\n\nmore public agencies defaults in the payment of its obligations\n\nunder such contract and agreement, the remaining public agencies\n\nhaving such contracts and agreements shall be required to pay for\n\nand shall be entitled proportionately to use or otherwise dispose of\n\nthe products and services which were to be purchased by the\n\ndefaulting public agency.\n\nD. Each such contract and agreement shall be a limited\n\nobligation of a public agency payable from and may be secured by a\n\npledge of and lien and charge upon, all or any part of the revenue\n\nderived or to be derived from the ownership and operation of its own\n\nwater or sewage facility or system and, if so provided in such\n\ncontract or agreement, shall be an expense of operation and\n\nmaintenance thereof and shall not constitute an indebtedness of the\n\npublic agency for the purpose of any statutory limitation.\n\nE. Nothing in this act shall be construed to preclude a public\n\nagency from appropriating and using revenues received in any year to\n\nmake payments due or to comply with covenants to be performed during\n\nthat year under any contract or agreement entered into as\n\ncontemplated in this act.\n\nF. Any such contract or agreement may include provisions for\n\nthe sale of services of a particular project or activity or for the\n\nsale of services generally without regard to a specific project or\n\nactivity, or for the supply of a specific quantity of water or other\n\nspecific services, or a percentage thereof, or for the supply of\n\nwater or other services based upon the requirements of the purchaser\n\nand on such other items and conditions as the board of directors and\n\nthe contracting or agreeing party deem appropriate.\n\nG.
