Any county of this state, the territorial limits of which\n\nare totally within the boundaries of a regional water district\n\norganized under the provisions of this act, and which is qualified\n\nto levy a county sales tax pursuant to the provisions of Sections\n\n1370, 1371 and 1372 of Title 68 of the Oklahoma Statutes, may, by a\n\nmajority vote of its board of county commissioners, deem water\n\nfacilities and sewer facilities, as defined in this act, to be\n\ncapital improvements.\n\nB. Any county of this state qualified under subsection A of\n\nthis section which follows the proscriptions mandated in Sections\n\n1370, 1371 and 1372 of Title 68 of the Oklahoma Statutes, may use a\n\nportion not to exceed forty percent (40%) of the proceeds of said\n\ncounty sales tax to contract with the regional water district for\n\nthe specific purpose of financing such planning and capital costs,\n\nor reimbursing such planning and capital costs as are properly\n\nassociated with the construction, erection, purchase or acquisition\n\nof plants, buildings, works, property rights, transportation and\n\ndistribution lines, facilities or equipment of systems necessary to\n\ntransport, distribute, sell, furnish, treat, store and dispose of\n\nwater or sewage by the district.\n\nC. Any sales tax levied pursuant to Sections 1370, 1371 and\n\n1372 of Title 68 of the Oklahoma Statutes and approved by a majority\n\nof the registered voters of the county voting thereon shall be, and\n\nis herein declared to be a county tax; however, nothing in this act\n\nshall prohibit the board of county commissioners of any county\n\nqualified under the provisions of subsections A and B of this\n\nsection from specifying, in advance of an election called to approve\n\nthe imposition of said tax, that the intended use and purpose of a\n\nportion of the proceeds of such levy are to be contractually\n\nobligated to the district.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6c893533bba9471a10e6a08b6f73bad7f6de256218ee17e401aaf920a01b7aab","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-1284","next":"us-ok/okla.-stat.-tit.-82-82-1286"},"notice":"GroundRules: Original legal text.
