Stat. tit. 82, § 82-1324.2","heading":"Definitions","body":"As used in this act unless the context clearly requires\n\notherwise:\n\n1. \"District\" means a public nonprofit water district, a\n\nnonprofit sewer district, a public nonprofit natural gas\n\ndistribution district or a nonprofit solid waste management district\n\nor a district for the operation of all or a combination of\n\nwaterworks, sewage facilities, natural gas distribution facilities\n\nand solid waste management systems, created pursuant to this act;\n\n2. \"Board\" means the governing body of a district;\n\n3. The terms \"board of county commissioners\" and \"county clerk\"\n\nshall mean, respectively, the board of county commissioners and\n\ncounty clerk of the county in which the greatest portion of the\n\nterritory of any proposed rural water district, rural sewer\n\ndistrict, rural natural gas distribution district or rural solid\n\nwaste management district is located;\n\n4. \"Corporation\" means a not-for-profit corporation organized:\n\na. pursuant to the provisions of the Oklahoma General\n\nCorporation Act for a purpose not involving pecuniary\n\ngain to its shareholders or members, paying no\n\ndividends or other pecuniary remuneration, directly or\n\nindirectly to its shareholders or members as such and\n\nhaving no capital stock, and\n\nb. for the purpose of developing and providing rural\n\nwater supplies to serve rural residents.\n\n5. \"Rural resident\" means any natural person, firm,\n\npartnership, association, corporation, business trust, federal\n\nagency, state agency, state or political subdivision thereof,\n\nmunicipality of ten thousand (10,000) persons or less, or any other\n\nlegal entity, owning or having an interest in lands within the rural\n\narea located within the boundaries of the district;\n\n6. \"Rural area\" means any area lying outside the corporate\n\nlimits of any municipal corporation and includes any areas of open\n\ncountry, unincorporated communities, and, with the consent of the\n\ngoverning body thereof by ordinance duly adopted, may include the\n\narea within the corporate limits of any municipality having a\n\npopulation of less than ten thousand (10,000) persons according to\n\nthe last decennial census, when said municipality is one of the\n\npetitioners for creation of a district or for the annexation of\n\nadditional territory as provided by Section 1324.13 of this title;\n\nprovided, further, that when a water, sewer, natural gas or solid\n\nwaste management district is totally within the municipal city\n\nlimits of a city with ten thousand (10,000) population or less, the\n\nboard of directors of the sewer, natural gas, water or solid waste\n\nmanagement district shall be the governing body of the town.\n\nProvided, further, that when a city or town with a population of ten\n\nthousand (10,000) or less receives the majority of its water from a\n\nrural water, natural gas, sewer or solid waste management district,\n\nany resident of said city or town shall be eligible to serve on the\n\nboard of directors. Provided, further, that areas lying within the\n\ncorporate limits of any municipality having a population of more\n\nthan ten thousand (10,000) persons according to the last decennial\n\ncensus may be included in a water, sewer, natural gas or solid waste\n\nmanagement district with the consent of the governing body by\n\nordinance duly adopted when such water, sewer, natural gas or solid\n\nwaste services are not and cannot be provided in a reasonable time\n\nby other sources;\n\n7. \"Benefit unit\" means a legal right to one service connection\n\nto the district's facilities and to participate in the affairs of\n\nthe district;\n\n8. \"Participating member\" means any rural resident who has\n\nsubscribed to one or more benefit units;\n\n9. \"Sewage facilities\" means the necessary facilities of\n\ncollection, transportation, storage, treatment or processing and\n\ndisposal or release of sewage;\n\n10. \"Solid waste management system\" means the entire process of\nthe district;\n\n8. \"Participating member\" means any rural resident who has\n\nsubscribed to one or more benefit units;\n\n9. \"Sewage facilities\" means the necessary facilities of\n\ncollection, transportation, storage, treatment or processing and\n\ndisposal or release of sewage;\n\n10. \"Solid waste management system\" means the entire process of\n\ncollection, transportation, storage, processing and disposal of\n\nsolid wastes;\n\n11. \"Water works\" means the necessary facilities from the\n\ninitial source to the place for consumer utilization, and includes\n\nsupply, storage, treatment, transportation and distribution;\n\n12. \"Solid waste\" means all putrescible and nonputrescible\n\nrefuse in solid or semisolid form including, but not limited to,\n\ngarbage, rubbish, ashes or incinerator residue, street refuse, dead\n\nanimals, demolition wastes, construction wastes, solid or semisolid\n\ncommercial and industrial wastes and hazardous wastes including\n\nexplosives, pathological wastes, chemical wastes, herbicide and\n\npesticide wastes; and\n\n13. \"Gas distribution facilities\" means the necessary\n\nfacilities from the initial source to the place for consumer\n\nutilization and includes supply, transportation and distribution.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e1287395d61e70ae2b83c275aa9557499f69256aef264b33cca48fa989fca1a9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-1324.19","next":"us-ok/okla.-stat.-tit.-82-82-1324.20"},"notice":"GroundRules: Original legal text.
