Stat. tit. 82, § 82-1324.25","heading":"Annexation of additional territory - Petition","body":"Two or more districts organized under this act may be\n\nconsolidated into a single district by complying with the procedures\n\nprescribed in this section.\n\nThe proposal for consolidation shall be prepared in written form\n\nand shall set forth in detail the reasons for consolidation and the\n\nadvantages which would accrue to each district from the proposal.\n\nThe written proposal shall be considered and acted upon by the board\n\nof directors from each district affected at a duly called meeting.\n\nIf the board of directors of each district approves the proposal by\n\nresolution, the proposal shall then be submitted to a vote of the\n\nmembership of each district at a regular or special membership\n\nmeeting. If the consolidation proposal is not approved by the\n\nmembership of each district affected such districts may not be\n\nconsolidated.\n\nIf the proposal is approved by the membership of each district,\n\nthe boards of directors shall then submit it to the creditors of\n\neach district for approval or disapproval. In the event the\n\ncreditors do not approve the consolidation proposal, the districts\n\nshall not be consolidated.\n\nUpon approval of the proposal by the membership of each district\n\nand by all creditors, the board of directors of the districts\n\ndesiring to be consolidated shall join in filing a petition,\n\naddressed to the board of county commissioners having jurisdiction\n\nas provided by this section, for a hearing to consolidate such\n\ndistricts into a single district. Said petition shall set forth the\n\nnecessity for such consolidation of two or more districts, and that\n\nthe consolidation of said districts shall be conducive to the public\n\nhealth, convenience, safety or welfare, and to the economical\n\nexecution of the purposes for which the districts were organized.\n\nThe consolidation proposal as approved by the membership and the\n\nboards of directors of each district and the approval of each of the\n\ncreditors shall be attached to the petition as exhibits.\n\nIf the districts seeking consolidation are situated in one\n\ncounty, the petition shall be filed with the county clerk of said\n\ncounty, and the board of county commissioners of said county shall\n\nhave jurisdiction to hear and determine the petition.\n\nIn the event the districts were organized in different counties\n\nthe petition shall be filed with the county clerk of the county in\n\nwhich the greatest portion of the territory of the proposed\n\nconsolidated district is located, and the board to determine the\n\nquestion of consolidation shall consist of the board of county\n\ncommissioners from each of the counties, and a majority of the\n\ncombined boards shall be necessary to render a decision.\n\nUpon receipt of said petition, the county clerk shall thereupon\n\ngive notice to the board or boards of county commissioners of the\n\nfiling and pendency of said petition, whereupon the county\n\ncommissioners of the county wherein the petition is filed shall\n\nenter its order setting hearing, and giving notice of the hearing,\n\nall in accordance with the provisions of this act for the creation\n\nof districts in the first instance. In addition to the notice as\n\nprescribed by the act for the creation of districts, the county\n\nclerk shall at least ten (10) days before the date fixed for said\n\nhearing give or send by registered mail or certified mail notice\n\nthereof to each creditor of each of the districts to be\n\nconsolidated, addressed to the creditor's last-known address.\n\nAfter the hearing, should the board find that the averments of\n\nthe petition are true and that said districts, or any of them,\n\nshould be consolidated, the board shall enter its order directing\n\nthe consolidation of the districts. The order shall set forth the\n\ncorporate name of the consolidated district under the name of\n\n\"Consolidated Rural Water and/or Sewer District and/or Gas District\n\nand/or Solid Waste Management District No._____, __________ County\nof\n\nthe petition are true and that said districts, or any of them,\n\nshould be consolidated, the board shall enter its order directing\n\nthe consolidation of the districts. The order shall set forth the\n\ncorporate name of the consolidated district under the name of\n\n\"Consolidated Rural Water and/or Sewer District and/or Gas District\n\nand/or Solid Waste Management District No._____, __________ County\n\n(ies), Oklahoma.\" The order shall further provide that the\n\nconsolidated district shall assume and become legally liable for all\n\nof the obligations of the districts consolidated into the single\n\ndistrict.\n\nFollowing the entry of said order, an organizational meeting of\n\nthe combined membership of each of the districts shall be held for\n\nthe purpose of electing directors and officers, and adopting bylaws.\n\nThis organizational meeting shall be held in accordance with the\n\nprovisions pertaining to the creation and organization of districts.\n\nFrom any order of the board, an appeal may be taken in the manner as\n\nprovided for appeals from decision of the board of county\n\ncommissioners.\n\nAll legal proceedings already instituted by or against any\n\ndistrict involved in a consolidation proceeding may be revived and\n\ncontinued by or against the consolidated district by an order of the\n\ncourt substituting the name of such consolidated district.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"130ac2f2b6b3ab3a77f36ed5d23184bf91ed7e6a8b911fc45f2a5fb0690de579","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-1324.24","next":"us-ok/okla.-stat.-tit.-82-82-1324.26"},"notice":"GroundRules: Original legal text.
