Stat. tit. 82, § 82-1501-205.1","heading":"Definitions - State Geographic Information Council","body":"A. As used in this section and in Sections 1501-205.2 and 1501-\n\n205.3 of this title:\n\n1. \"Geographic information\" means any data or databases in\n\nwhich location or spatial distribution is an essential element\n\nincluding, but not limited to, land, air, water, and mineral\n\nresources, the distribution of plant, animal, and human populations,\n\nreal property interests, zoning and other land development\n\nregulations, and political, jurisdictional, ownership, and other\n\nartificial divisions of geography;\n\n2. \"Geographic Information System\" or \"GIS\" means computer\n\nsystems that allow the analysis of data or databases containing\n\ngeographic information; and\n\n3. \"Statewide data\" means geographic information whose spatial\n\nextent is defined by the geographic boundary of this state.\n\nB. There is hereby created a State Geographic Information\n\nCouncil composed of nineteen (19) members as follows:\n\n1. Director of the Oklahoma Conservation Commission or\n\ndesignee;\n\n2. Director of the Department of Environmental Quality or\n\ndesignee;\n\n3. Chair of the Corporation Commission or designee;\n\n4. Director of the Oklahoma Department of Commerce or designee;\n\n5. Commissioner of the Oklahoma Department of Agriculture,\n\nFood, and Forestry or designee;\n\n6. Director of the Oklahoma Water Resources Board or designee;\n\n7. Director of the Department of Transportation or designee;\n\n8. State Geographer or designee;\n\n9. Director of the Oklahoma Geological Survey or designee;\n\n10. Director of the Center for Spatial Analysis of the\n\nUniversity of Oklahoma or designee;\n\n11. Dean of the Division of Agricultural Sciences and Natural\n\nResources of Oklahoma State University or designee;\n\n12. Director of the Ad Valorem Division of the Oklahoma Tax\n\nCommission or designee;\n\n13. A member appointed by the Director of the Oklahoma\n\nConservation Commission from a list of names submitted to the\n\nDirector from the Oklahoma regional universities;\n\n14. Director of Information Services of the Office of\n\nManagement and Enterprise Services or designee;\n\n15. State Wildlife Conservation Director or designee;\n\n16. Director of Homeland Security or designee; and\n\n17. Three members to be appointed by the Governor pursuant to\n\nsubsection C of this section.\n\nC. The Governor shall appoint three members to the Council to\n\nserve initial terms as specified by this subsection. Thereafter,\n\nthe terms of all appointed members shall be four (4) years.\n\nGubernatorial members shall not be appointed to more than three\n\nsuccessive terms. Members that are appointed by the Governor to\n\nfill a vacancy may serve three successive terms. No appointment to\n\na partial term to fill a vacancy shall be counted for purposes of\n\ndetermining term limits. Incumbent members may continue to serve on\n\nthe Council until a new appointment is made. The following members\n\nshall be appointed by the Governor:\n\n1. A representative of the Oklahoma Association of Regional\n\nCouncils, appointed for an initial four-year term;\n\n2. A representative of county assessors, appointed for an\n\ninitial three-year term; and\n\n3. A representative of city government, appointed for an\n\ninitial two-year term.\n\nD. The chair of the Council shall be the Director of the\n\nOklahoma Conservation Commission or designee. Meetings shall be\n\ncalled by the chair.\n\nE. 1. A majority of the membership of the Council constitutes\n\na quorum for the conduct of business.\n\n2. The Council shall meet at least twice each year, and the\n\nchair may call a meeting of the Council as often as necessary to\n\ntransact business.\n\nF. A member of the Council shall not:\n\n1. Be an officer, employee, or paid consultant of a business\n\nentity that has, or an officer, employee, or paid consultant of a\n\ntrade association for business entities that have, a substantial\n\ninterest in the geographic information industry and are doing\nach year, and the\n\nchair may call a meeting of the Council as often as necessary to\n\ntransact business.\n\nF. A member of the Council shall not:\n\n1. Be an officer, employee, or paid consultant of a business\n\nentity that has, or an officer, employee, or paid consultant of a\n\ntrade association for business entities that have, a substantial\n\ninterest in the geographic information industry and are doing\n\nbusiness with state agencies or other governmental units of the\n\nstate;\n\n2. Own, control, or have directly or indirectly, more than ten\n\npercent (10%) interest in a business entity that has a substantial\n\ninterest in the geographic information industry and is doing\n\nbusiness with state agencies or other governmental units of the\n\nstate;\n\n3. Be an officer, employee, or paid consultant of a business\n\nentity that is connected with any contract or bid for furnishing to\n\nany governmental body of the state with Geographic Information\n\nSystems, the computers on which they are automated, or a service\n\nrelated to Geographic Information Systems;\n\n4. Be a person required to register as a lobbyist because of\n\nactivities for compensation on behalf of a business entity that has,\n\nor on behalf of a trade association of business entities that have,\n\na substantial interest in the geographic information industry; or\n\n5. Accept or receive money or another thing of value from an\n\nindividual, firm, or corporation to whom a contract may be awarded,\n\ndirectly or indirectly, by rebate, gift or otherwise.\n\nG. The duties of the Council shall include overseeing the\n\nOffice of Geographic Information concerning the following:\n\n1. Development, adoption, and recommendation of standards and\n\nprocedures that may be applied to geographic information and\n\nGeographic Information Systems to promote consistency of data\n\nelements;\n\n2. Development of a strategy for the implementation and funding\n\nof a statewide Geographic Information System;\n\n3. Development, delivery, and periodic revision of a statewide\n\ngeographic information plan and annually reporting to the Governor\n\nand the Legislature. Such a plan shall include, but not be limited\n\nto, provisions for training and education; and\n\n4. Promotion of collaboration and sharing of data and data\n\ndevelopment as well as other aspects of Geographic Information\n\nSystems.\n\nH. Neither the Council nor its members shall have the power to\n\nform or award contracts or to employ staff.
