After a floodplain board has adopted and submitted\n\nfloodplain management regulations incorporating the most recent\n\nflood insurance rate maps or flood hazard boundary maps prepared by\n\nthe Federal Emergency Management Agency or containing more specific\n\ninformation to delineate floodplains within the respective areas of\n\njurisdiction to the Oklahoma Water Resources Board, all platting of\n\nland, all construction of dwelling units or commercial or industrial\n\nstructures, and all future development within the delineated\n\nfloodplain area is prohibited unless:\n\n1. Floodplain regulations have been adopted pursuant to the\n\nOklahoma Floodplain Management Act for the delineated floodplain\n\nareas and are in full force and effect;\n\n2. Prior to the platting, construction, and other development,\n\na development permit is granted by the floodplain board or\n\naccredited floodplain administrator if a floodplain administrator is\n\nauthorized to issue development permits by the floodplain management\n\nregulations; or\n\n3. A development permit is granted by the Board, if development\n\nor construction is proposed on lands owned, held in trust or\n\noperated by the state. Notice of the proposed construction or\n\ndevelopment must be provided by the permit applicant to the\n\nrespective floodplain board of the county or municipality in which\n\nthe development or construction is proposed thirty (30) days before\n\nthe decision of the Board to approve a development permit for the\n\nconstruction or development.\n\nB. Development permits authorized by subsection A of this\n\nsection may be issued when the applicable floodplain board, or\n\naccredited floodplain administrator or Board, as the case may be,\n\ndetermines that construction or development in the floodplain in\n\nquestion complies with the applicable floodplain regulations or\n\nrules and is not a danger to persons or property.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"05637056d6bf050c5706d0283c3a31aad836231884a851df6455dd6b34ac05f9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-1611","next":"us-ok/okla.-stat.-tit.-82-82-1613"},"notice":"GroundRules: Original legal text.
