Stat. tit. 82, § 82-502","heading":"Organization of districts - Petition - Notice","body":"When in the opinion of the Conservation Commission of the State\n\nof Oklahoma, the organization of irrigation, flood control,\n\nreforestation and/or soil erosion prevention districts is necessary\n\nand expedient to effect the purposes and intentions of House Bill\n\nNo. 84, of the Fifteenth Legislature and all laws to which said act\n\nis cumulative, said Commission may perfect the organization of said\n\ndistrict or districts by filing with the court hereinafter\n\nprescribed a petition alleging the necessity of said district,\n\ndescribing with common certainty the area proposed to be included\n\ntherein and praying for an order of the court directing the\n\nformation and organization thereof. Upon the filing of such\n\npetition, without affidavit or further pleading, the clerk of such\n\ncourt shall give notice to all persons interested in or affected by\n\nthe formation of any such district by publication once a week for\n\ntwo successive weeks in a newspaper, published in the county seat of\n\neach county in which any part of the proposed district is located.\n\nSaid notice shall run in the name of the State of Oklahoma, shall be\n\ndistrict\" and shall be addressed \"To all persons interested\" in the\n\nformation thereof; said notice shall recite the filing of such\n\npetition and describe with common certainty the area proposed to be\n\nincluded in such district and shall notify all persons interested or\n\naffected by the organization of such district to appear in not less\n\nthan fifteen (15) days after the date of the first publication of\n\nsaid notice and show cause, if any they have, why such district\n\nshould not be organized.\n\n(a) In cases where all of said proposed district lies within\n\none county, the petition for the organization thereof shall be filed\n\nwith the district court of such county and where the proposed\n\ndistrict lies in more than one county, but within one judicial\n\ndistrict, such petition may be filed in either county of such\n\njudicial district.\n\n(b) In cases where the proposed conservancy district lies in\n\nmore than one judicial district, the petition for the formation\n\nthereof shall be filed in the Supreme Court of the State of\n\nOklahoma. When such petition is filed in the Supreme Court of the\n\nState of Oklahoma, the clerk shall docket the same as an original\n\naction in such Court and the Supreme Court or any member thereof,\n\nshall forthwith determine which district court of this state is more\n\nconveniently near the center or middle of said proposed district and\n\ncan hear and determine said petition to the greatest convenience of\n\nthe people within said district, having in view the customary route\n\nof travel; and shall thereupon refer and assign said petition and\n\nproceeding to such district court and direct the hearing,\n\ndetermination and control and administration of such proceeding as\n\nan original action therein.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7094da67698cedb717111b19f791f308dfd1881d9cb187dbbda18c4f96ec2fd6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-501","next":"us-ok/okla.-stat.-tit.-82-82-503"},"notice":"GroundRules: Original legal text.
